If the child consents, why should that be a problem or even against the law? Do children have no civil rights? If they live with abusive parents, or are forced to live in foster care, and hate it, I guess that's too bad because they are not old enough to be able to make responsible decisions about their own lives. Right? So, in other words, children are property to posess until they are 16, 18, or whatever it is, right? At what point to children have the freedom to choose their own happiness? Do state courts decide? Based on WHAT? Maybe the courts should decide that if children should be able to have sex with whomever they wish as long as they sign a consent form or be interviewed to see that they are not being manipulated into anything pedophilia would be allowed, right? The reason hy we are all hiding behind God on this issue is because it is a matter of morality. There has never been a society to agree on morality and decide to set it in stone as "objective" some societies allow murder in specific ways and others allow rape. There are several instances in America where school teachers have had relationships with the students, some in their early teens. In some cases the children were willing, and even wanted to continue the relationship after the teacher came out of jail. These teachers clearly have major problems, but there was no attack involved. Do the children have a right to make their own choices? If so, why not give pedophiles rights as gays? If it's good for one group it should be good for the others. My point is that if you give gays legal rights, then you will will eventually have to give the same rights to those who will claim the same legal protection to sleep with whomever (or even whatever) they wish. As a US citizen who has taken the trouble to find out a little about US government, I think that in cases involving personal status like marriage, divorce, child custody, etc., the right to make laws belongs to the individual states, not the Federal government. At least, that seems to be what the Constitution says. The Bill of Rights may also be relevant here, forbidding government intervention in private behavior. In any case, passing laws against what some people believe is immoral when a lot of other people don't agree doesn't solve anything. In the 1920's the US amended the Constitution to forbid alcohol, when a large percentage of the population didn't agree. The only lasting result was the growth of organized crime to provide alcohol. The ones who wanted to drink continued to drink. Eventually another amendment was passed cancelling the original amendment. Passing such an amendment wouldn't have any effect on the behavior involved. Better to let each State deal with the issue in its own way.
