Court to determine whether Israelis can sue PA    Aviram Zino
1. Can refugees sue israel for being displaced?
papa jay   (05.24.07)
2. Heck, sue 'em all as individuals.
M. Hartley ,   Atlanta, US   (05.24.07)
3. To no 1
Then i hope the 1 million jewish refugees sue the pants of the arabs countries that forced them to flee.
Y ,   N   (05.24.07)
4. Why not ?
But let's start from 1920 till now and let's counting the damages in both sides and and then we see who has to pay to who ..... like this it's fair .
(05.24.07)
5. Legal eagles: What does the international law says about
suing terrorists? Because that's what they are.
Richard   (05.24.07)
6. # 1 No can do papa
Palestinians displaced themselves while their Israeli Arab brothers and sisters elected to stay. The Palestinians now regret leaving. Israeli terror victims should definitely sue the PA for damages. Then withhold the funds from taxes owed.
Lina ,   USA   (05.24.07)
7. Can we sue Israel for ..?
Can I sue Israel as a Palestinian for the daily killing of my people, the displacement of my grandparents from our land, the systematic distruction of our homes and villages for the past 60 years?
Sattouf ,   USA   (05.24.07)
8. Sounds good to me.
Now let the Palestinians sue the Israeli government & the IDF for 40 years of occupation, land theft, water theft, home demolition, imprisonment w/o trial, and wanton diregard for human life and limb.
J. Johnson ,   Turks & Caicos   (05.24.07)
9. to # 6: pals displaced themselves?? nice!!
how do you figure that? they were living there and one summer day in 1948 the entire population decided to just up and leave out of free will. can you say that with a straight face?
papa jay   (05.25.07)
10. #9 and #1 "Displacement"...
The Palestinian refugee issue is often used as the ‘tip of the spear' in the war against Israel. As regards allegations of "displacement", it is expediently overlooked that in 1948 there would not have been one single Arab refugee - NOT EVEN ONE - had the Arab states not chosen to go to war in defiance of a United Nations resolution with the declared aim of destroying the newly reborn State of Israel. Between 1948 and 1967, the Arabs (Jordan & Egypt respectfully) illegally occupied the so called "West Bank" (Judea & Samaria) and Gaza. During this NINETEEN year period of Arab occupation, no moves were made to create any Palestinian state in these territories. Instead the territories were used as a base and platform from which to launch terrorist attacks into the Jewish state. Indeed the PLO was created in 1964 by Egypt, which raises the question as to what "Palestine" exactly they needed to liberate. At any point during the past 59 years since the re-birth of Israel in 1948, Arab governments could have helped the Palestinian Arabs settle down to a decent life. They could have created the infrastructure of an autonomous Palestine on the West Bank of the Jordan and the Gaza territory that Egypt controlled until 1967, or encouraged the resettlement of Palestinians in Jordan, (which constitutes the lion's share of the original mandate of Palestine). Rather than fund the Palestine Liberation Organization to foment terror against Israel they could have endowed Palestinian schools of architecture, engineering, medicine and law. What Israel did for its equally large number of refugees forcibly expelled from Arab lands during the same period, Arabs could have done much more sumptuously for the Palestinians displaced by the same conflict. Instead the Arab world caused the "displacement" of the Arabs now known as "Palestinians" as they sought the very same agenda now being propagated by Hamas and it's minions - the eradication of Israel. Again such an agenda wants to be pursued with impunity, condemning any retaliation by Israel and without the possibility of being sued for such actions.
Jane ,   Gwent, UK   (05.25.07)
11. #1 - Yes, Israel is Liable as well
Yes, Palestinians can sue Israel for damages in international courts and have Israeli assets seized to pay damages for war crimes committed by Israel in the occupied West Bank and Gaza. Many precedents have been set by Jews seeking damages and compensation for property stolen in WW2, and those can now be used to seek damages due to Israel's state sponsored terrorism and war crimes against those living under Israeli occupation. The ICJ has also ruled that Palestinians can sue for damages due to the apartheid wall deemed illegal under international law by the ICJ.
Fred Farkelsteinman ,   NY, NY USA   (05.25.07)
12. Stupid idea and stupid talkbacks (papa jay)
I agree with these anti-Israel spewers that suing is an idiotic premise because both sides have something to sue about. But your "40 years of occupation, destruction of human life" speech has become robotic. Papa Jay, clearly they didn't all get up randomly and leave. But the fact is, in '48, there was a war, an ethnic war; Jewish village vs Arab village, side by side, neighbors becoming enemies. Many Arabs fled in fear of being caught up in the war between advancing Arab armies and the Haganah (quite logically), and most believed they would return when Israel was removed. Many Jews left their respective cities to any other safe enclave too, and Arab armies expelled Jews deeper into Israeli territory while the Haganah did expel some Palestinians, maybe 15000 or so from some villages, off their land. But 15000 does not equal 700000, or 1000000. There is no way the Haganah, not fully organized, using ancient Czech weaponry, and fighting against over 10 surrounding nations' armies, could go in to every Arab village in the region and "expel" them behind advancing Arab armies. It was a war and people get displaced during war, especially ethnic war. There is no evidence of, and there was no massive ethnic cleansing campaign on part of the IDF. In fact, it was surrounding armies that wan't to ethnically "cleanse" every Jew in the region, even though the Jews were not living on Arab territory as the vilages were separate and the Jewish villages were bought form Turkish landlords in the 1800s. The history of 48 is very interesting and very complex. Don't try to make it simple like the storyline of a video game.

13. Jews
Long live muslim apartheid, no jews/christians allowed to return to the arab countries, muslim apartheid forever.
Kapara al Haismuk ,   Saudi Arabia   (05.25.07)
14. papa jay
Did you see what happened last summer when lebanese army crossed international recognized boarder into israel, killed soldiers, destroyed tank, and kidnapped 2 soldiers starting a war? Did you see how fast hundreds of thousands of lebanese fled north, fled the warzone. Same thing happened in 1948. Straight face.
Kapara al Haismuk ,   Saudi Arabia   (05.25.07)
15. 1 Can the christians sue the PA for their
eviction from Bethlehem. Bring it on. Ive got more facts for people like you.
freedom ,   canada   (05.25.07)
16. Like a robber sues the people he robs cuaz they resist
What needs to be sued is the Jewish armed-robbery of Palestine.
Jalin ,   USA   (05.25.07)
17. To # 7
You can sue your grandparents for their absentee landlordship and legitimately selling land to the Jews on already underpopulated lands. Enough arab lies and false claims!
Alef ,   USA   (05.25.07)
18. #9
I CAN SAY THIS WITH A STRAIGHT FACE BECAUSE MY FATHER WAS THERE!!!!!!!!!!!!!!! the jews then BEGGED the arab residing in then jewish palestine not to leave because nothing will happen to them. the jews announced these messages with the "ramkol" a loud speaker, in hebrew. they went from settlement to settlement and explained the situation. but, unfirtunatelly, all the arab nations surrounding us gave them another message. they told them to run for their lives because they intend to come in and murder every last jew in towns and villages...and when all the jews are done, then the arabs can come back and continue where they left off. at least the 7 arab nations who attacked the jewish homeland had the decency to warn their brothers that they are coming and get them away from harms way. then they attacked. a huge percentage of arabs believed their brothers' call and fled despite the jewish call that they stay and not run away. this is very welol doccumented in history books, not necessarily written by jews, but by people who don't make it a practice to twist historical facts on the ground. i suggest you read and get some faqcts straight because you are 100% clueless and sound like a stupid a*s shooting your mouth off. if you spend less time on ynet and more in the library, it'll do you a world of good, believe me! unfortunatelly for the murderous antisemetic arab nations, a miracle occured and israel defeated all of them in what can only be described as relying on pure determination and a strong will to survive, build and self actualize. those arabs that stayed were granted full israeli citizenships after israel was declared a viable nation, recognizede and legitimized by the entire world. we do not excuse our survival. we revel in it! those arabs choosing to believe the arabs' call to arms and fleeing their homes and places of work, could never come back. they became refugees by their own brothers. had they not left, the story would have been quite different now and they would have lived under a democracy, not in refugee camps. question to you..... why is there a palestinian refugee camp in lebanon till today? why are they not incorporated into the lebanese society and given citizenship and the same rights enjoyed by lebanese? why didn't the palestinians demand a state of their own when ruled under egypt (gaza) and jordan (west bank)??? why did these countries keep them refugees? especially when jordan is comprized of 80% palestinian population? DON'T YOU THINK JUST FOR ONE MOMENT THAT ALL ARAB COUNTRIES USE THESE POOR PALESTINIANS AS A TOOL AND PROPAGANDA AGAINST ISRAEL AND TOWARDS ITS DESTRUCTION? MOST OF THESE COUNTRIES COULD HAVE GIVEN A HAVEN TO THESE SO CALLED MISPLACED INDIVIDUALS, BUT THEY CHOSE TO IGNORE THEM AND PUT THEM INTO THE TRASH BINS THEY ARE IN TODAY. ISRAEL RESCUED DARFUR REFUGEES AS WELL AS UPLIFTED THOUSANDS OF ETHIOPEANS FOR THE PURPOSE OF GRANTING THEM HAVEN AND REFUGE. WHY CAN'T ARAB NATIONS DO THE SAME? because it is better to use defensless people like the palestinians as a tool to demonize and delegitimize the jewish nation. that is why.
(05.25.07)
19. No, dear papa & assorted others ...
Israel is a sovereign state, and it has immunity unless it has indicated otherwise by treaty. "Palestinians" as a group are probably legally stateless; they have no sovereign immunity whatsoever. This is one consequence of their decades-long belligerence. This is simple matter. Did Farfur omit it in his civics lesson to you y'all? In the US, a group that incites its members to go on killing sprees WOULD be sued to destruction, and it HAS happened. No reason to allow the PA to continue with business as usual.

20. papa jay (9)
"they were living there and one summer day in 1948 the entire population decided to just up and leave out of free will." Yes, papa jay. I explained this in a TB that the censor deleted. To repeat, your buddies left so that the Arab armies could treat the land like a killing field, murdering the Jews. The idea was that neighboring Arabs could then reclaim their land and add to that the Jews' land now with no living owner. Do you understand? You should. This is way Arabs fight wars.
sk ,   USA   (05.25.07)
21. To #9 ...papa jay
The Pals and other arab countries attacked the Jews killing civillians in 1947-48, Pals should be thankful the Israeli army granted them an option to be displaced or otherwise given them an escape route to neighboring arab states rather than exterminating them as mercilessly as Jews were at the time. And I do say this with a straight face!
Alef ,   USA   (05.25.07)
22. conflicting stories. jews should get thier story striaght
some on this TB say the jews "begged" the arabs to stay. they shouted it from loud speakers. that by far is my favorit story. others say, be thankful the Israeli army granted them an option to be displaced or otherwise given them an escape route. and others say, yes, in face one summer day they did all up and leave. Great stories by everyone. i give all of you an A in creativity. and F in humanity i'm afraid.
papa jay   (05.25.07)
23. You must be f*cking kidding me.
Are you Israelis out of your minds?! What about the HUNDREDS of homes demolished all the time by the IDF?? Trust me losers, if this were a legitimate suing contest, Israel would be coughing up millions of more dollars than Palestinians would.
Khalid   (05.25.07)
24. PapJay #22
If anyone deserves an *F* for humanity, it's people like you and the other Palestinian supporters, who excuse, or even support the murder and constant attempted murder of Israeli civilians by the Palestinian terrorists.
Margaret   (05.25.07)
25. papa jay once again
Good job conveniently ignoring my "story".

we are not interested in grades habibi. we are interested in facts! and the facts speak louder than your severe lack of historical knowledge. unfortunatelly for you, or fortunatelly, you are so dense that no matter what reading you may do, you still create your own history and facts because it suits your agenda and interests. talk about humanity. you are taking about humanity? are the lebanese human when they keep palestinians in refugee camps with no citizenship? are the syrians human when they kick out palestinians from the country? is egypt human when it kept palestinians in gaza un der their rule withpout citizenship? is jordan human when they keep same without any citizenship? are the terrorists around the world human when they bombed european and american buildings, railroads, people? is hammas human in denying the palestinians any modicum of peace and prosperity by sending kasams to israel and furthering the possibility of a state for the palestinians? are the hamas humans when they kill their own people, their brothers? was arafat human when he stole billions of aid money so that his wife can live in luxury in paris while the common palestinian lives in squalor? by the way, the same monetarty confiscation and theft is going on thoday between hamas and fatah, in case you don't get it. it's a struggle and a war about who is going to get their filthy hands on foreign aid. is iran human when it just excuted a 16 years old girl in public hanging because she happened to show improper sexual behavior in public? was nasrallah human when he crossed international recognized borders, killed and kidnapped israeli soldiers and butchered them then caused a riot of a war in lebanon? get your facts straight. we are all laughing at you and what you are saying. a more imbecilic person i have never seen. where are you from, the moon? and no, i am not jewish, not israeli, not christian, but muslim. a liberal muslim that knows what is good for the arabs. and terrorism is not good. i live in america now. the land of the free and i have come to understand how my people operate. too much emotion and not enough brain.

27. New Zealand situation 150 years on.
Compensation claims for illegal land confiscation and sales are still being heard in New Zealand 150 years down the track. the current generation is therefore taking responsibilty for what occured 150 years ago. Therefore one can expect that for the next 100 years Israeli Jews will be required by International pressure to pay for the displacement and suffering of Palestinians. It is therefore important that every atrocity including quassam rocket attacks is properley documented as well as every assasination and home bulldozing by Israelis.

I think that should win best talkback of the month award!
Korem ,   New York, USA   (05.25.07)
29. Khalid, no one said Palestinians couldn't sue
for damages too, but nobody will "cough up millions" unless they win their case. Good luck.
(05.25.07)
30. More Peter Morris drivel
Tell me Pete, what do the Jews get for 2000 years of diaspora (viz. forceful expulsion) from Israel? By your logic, they deserve full compensation from Rome. You can wake up now, Peter---wake up....
