Cast Lead... where israel warned with leaflets and phone calls... bent over backward to prevent civilian casualties. .....had that happened in world war 2 ... there would be a large swastica in each country around the world... How many phone calls were made by hamas before they launched thier qassams and mortors... how many leaflets were distributed to jewish residents warning them to get into thier bomb shelters...... To start with the refutation of the report, lets look at the introduction: The Goldstone Report states its mandate as to investigate all war crimes. The UNHRC decision was to investigate all war crimes committed by the occupying power - Israel. That is the first lie. Goldstone in a subsequent op ed stated that the change was approved by the president of the UNHRC. This has never been confirmed, not by the president nor by the UNHRC itself. The subsequent decision of the UNHRC in Geneva recently to refer the report to the U.N. with regard to Israel, with no mention of Hamas, shows that the UNHRC does not agree with Goldstone. So with this bald faced lie how should we look at the rest of the report ? Only problem is that Goldstone does not read these talkbacks, so what is the purpose ?

Goldstone himself stated that the testimony given before his commission would not stand up in a court of law. There was no cross examination, no attempt to corroborate the testimony of the Gazans. If this is the case, how can he come to the absolute conclusions that he came to ? it goes against all legal procedures and Goldstone as a lawyer should know this. Therefore, I disagree with him: Israel does not have to refute - Goldstone himself has to justify his conclusions in light of his own admissions. In effect, what he is saying is: I accuse you of killing children to use their blood for making matza - prove differently.

If you have any concept of legal procedures you would realize that the whole thing was a pre-ordained sham. The problem is that Goldstone, who should know better, and the UNHRC, who you would not expect anything different from them, are trying to take biased "testimony" and turn it into absolute legal decisions. And this, based on a total lack of legal procedure - even according to Goldstone himself. Goldstone lied outright - see My previous post about the mandate according to him and according to the UNHRC. He should be strong ? He should admit the shortcomings and lack of legal basis for all his conclusions.

Good points. I wonder how many of the so called experts who support Goldstone have actually taken the time to read the entire report. There are plenty of item all through it that can be challenged. Problem is - will anyone try to really do this (official Israel) and, more important, will Goldstone actually read and relate to the rebuttals.

I read part of the goldstone report dealing with methodology and conclusions. I read carefully, slowly as a forensic expert. Beyond the allegations and they are allegations only and not legal proof as he implies, it is obvious that the tone of the document is that hamas is innocent and israel is guilty. That witnesses were not cross eamined is a huge omission. If israel did behave to proper rules according to goldstone's interpretation, it would have a superman army commanded by God. No such army exists.Israeli actions occured while hamas rockets were being fired and not in a vacuum. Goldstone's military consultants must be from mars as the discrimination that israel would have to exercise doesn't exist. Israel hit the gaza police force in certain areas killing cops. Now Goldstone contends that most of them were engaged in civilian matters and not military affairs though he says that some of them may have been members of organisations. From general submissions provided, goldstone could have also concluded that hamas operates a revolving door of military to civilian and backwards. One of the reasons hamas is a difficult enemy is their rocket fire and use of human shielding and barbaric tactics. In the fog of battle, trying to avoid antitank missiles , ieds booby traps, capture, israelis are on hair trigger. Goldstone's yardstick is impossible in asymmetric warfare. Moreover, either hamas put on an elaborate hoax of lies or intimidated witnesses or hamas saw the light and opened their books for one and all. This same group threw atah operatives off the rooves of the buidings and goldstone covered none of this.It is my opinion, that goldstone got taken by hamas to the cleaners and his report is a legal exercise that belongs in the garbage can. A good lawyer or judge would not be taken to the cleaners and would at least cross examine his witnesses much as prosecutor cross examines his officers in a drug trial. I don't say the idf did not commit crimes. They likely did according to the old convention but they had to to defeat hamas which they did. Hamas got the hell kicked out of it with israel expending merely a fraction of its strength. it could have killed the entire population of gaza if it wished to. Rocket fire is down to serveral a day as opposed to 40-60 per day before the operation. So militarily it worked. Hamas by triggering the war with rocket fire, is responsible for the dead of gaza.

You state that Goldstone interviewed Israeli victims of terror in Sderot however, these victims complained Goldstone did not include their testimony in his report. Some traveled to the UN to lodge their complaint in person. 7500 kassams were fired at Sderot so there is plenty of evidence against Hamas. Please refer me to the pages in Goldstone's report where he addresses terror attacks against Israelis in Sderot. Look forward to your response.

when the typical mode of operation of organizations like Hamas and Hezbulah uses non uniformed fighters that intermingles among civilian populations for its own protection ....launching thier mortors and qassams from those positions... in my book the fighters who hide among the civilian population bear the larger responcability for the safety of that civilian population ...certianly those trying to take out enemy positions need to do thier best to minimize civilan casualties....colateral damage in war is always apossibility.

It was not Goldsotne alone, but Peres et al and their Oslo treaty that started this. Oslo gave immunity to PLO terror, and made Arafat legitimate. Hence, Hamas can only expect the same. The failure of Oslo was the trading of "land" for "peace". Whereas land has been surrendered, settlemens have been made illegal, peace has not been achieved. It has led to only more war. You're not familiar with the report and probably didn't bother to read it. Goldstone may have interviewed a few victims in Sderot but he disregarded their testimony. The UN did nothing to stop the kassams and now they want to cover-up their incompetence with Goldstone's report. Fault Israel instead of themselves.
