You are correct, Goldstone did apply the Apartheid laws when he was a judge (and before that as a lawyer) - most countries require their judges to apply the laws in place. Alan, Goldstone's mission was in fact one of 'fact finding' and was not a judicial exercise. That said, he was there to establish 'facts', and to report what he heard and present them for further investigation and (if necessary) judicial processes. Such reporting requires an assessment based on the balance of probability. The results of ‘fact finding’ do not constitute judicial evidence. The 'failure' (if the use of the word 'failure' is appropriate) of his report is as a result of Israel's non-participation. This non-participation was a great disappointment to Goldstone. Israel's opinion on the allegations made (by Hamas) was not heard and was therefore not part of the report. No Alan, I am not Jewish, but neither am I anti-Semitic, anti-Arabic, anti-Palestinian, anti-bushman, or anti-anything else. But I would dearly like to see the Israeli/Palestine issue resolved for the good of Israeli's and Palestinians (and indeed for the rest of us) so that this madness can stop. Alan, there are good countries with good laws, and there are bad countries with bad laws. Also there are good and bad lawyers, and many of these lawyers (good and bad) are elevated to the bench. Don't you think it better that a bad country with bad laws (SA for instance) has a predominance of good judges rather than bad judges? I have no idea what your profession is, but reflect a little ... your profession is likely governed by certain conventions and practices - some of which you might not agree with and which might offend your moral standards. In your profession it might be possible to flaunt the norms to quell your conscience. Judges do not have that luxury, they have to apply the laws of the land like it or not. Good judges can, however, use moral suasion to have bad laws changed, and because of their position their opinions are often persuasive. Finally from the judicial perspective, don't you agree that Goldstone did more than his share in bringing down a bad government (SA again) with bad laws?

Alan, from your posts it seems that you are probably Jewish and feel the need to protect Israel. I respect that, as long as you don't allow logic to be clouded by emotion. As I have implied, the Goldstone Report is merely a pre-curser to a credible investigation - no more. If the 'facts' are in fact 'lies', that will become clear with investigation. It's that simple! It really is in Israel's (and of course Hamas') interests to conduct such an investigation to clear the air. If they don't, their support will dwindle. This applies equally to Hamas and Israel. Without reasonableness and demonstrable morality from both Hamas and Israel NO SOLUTION WILL EVER BE POSSIBLE. If Israel were to conduct a credible investigation (and it was found that their actions were reasonable), firm support for Israel will be re-established and we will all be able to call the Hamas bluff. Wouldn't that be good for Israel?
