Shalom Hartman   (06.29.11)
Good ruling but what about when its the other way round and a woman refuses to accept a get? Why can't she be jailed indefinitely?
4. Horrific!
Ilan ,   London   (06.29.11)
a "religious court" has the power to imprison someone 1. for ten years 2. to change the conditions of their imprisonment to solitary (something a genuine court cant do) and 3. to send to prison for an unlimited time.... horrific beyond words, the jewish "mullahs" must be stopped! immediately! Theocracy must be eliminated!
5. re:#4 (Horrific)
michael ,   givat shmuel israel   (06.29.11)
Ilan, The husband is refusing to give his wife a divorce. She will not be able to remarry for the rest of her life. While you may object to the powers of the religious courts in general, it seems that IN THIS CASE the man is getting what he deserves. This is often missing from the civil court system when murderers and rapists walk free on technicalities.
6. Fight the fanatics or leave, what is better?
Michael ,   California, USA   (06.29.11)
This man exemplifies the boundless fanaticism of religious elements in Israel. It shows what a hard battle lies ahead of Israelis who want to continue their secular and democratic existence. I admire Israeli citizens who are continuing to fight off the fanatics but I do not envy them. To me, living the good life of today was preferable to fighting such fanatics, so I chose to leave Israel.
7. Get it........
Mike Carmel ,   Rishon le Zion   (06.29.11)
Get it into your thick skull that she doesn't want you, cabbage head. Then just sign the damn papers you stupid pathetic little man.
8. 2 prisoners
J.K. ,   Brooklyn USA   (06.29.11)
No government or court has the right to force a man to sign a document, giving up his house, his horse or his wife, governments have a right to confiscate properties by due process of the law without the consent of the owner, the husband does not own his wife to begin with,no human can own another human being, even if she is a woman, therefoe she doesn't need his signed consent to leave him,if i am not mistaken the American law is,if a couple don't live together for a year, the marriage is automatically annuled.
9. Dont compare
Joseph ,   Brooklyn, NY   (06.29.11)
A man, by Torah law can marry two women. He can also force the Get into her hands, It's just forbidden by a Cherem, but can be done with an approval of 100 Rabbi's. So Men aren't really chained the same way Women are without a proper divorce.
10. what a stupid system
oliver ,   eilat   (06.29.11)
what a stupid system, that a religios court can imposse indefinate prison sentances on poeple who refuse to give into divorce. Its time we put a stop to the rabbi mullahs

12. #6 Thank G-d you don't live in the Jewish land
Joy   (06.29.11)
If you can convince your anti-Jewish friends in Israel to join you in CA, it would be great and it would make a world of a difference for the Jewish country.
13. #3 She doesn't have to accept the get
Joy   (06.29.11)
in order for him to get married. Although it's not done today, according to Torah a man may marry several women.
14. A "get" by compulsion is not recognized by all
Raymond in DC ,   Washington, USA   (06.29.11)
Even assuming the "get" is obtained, some communities don't recognize it as valid if it results from compulsion. What's unfortunate is the refusal by rabbinic authorities to recognize that the current system is hardly equitable (only man can give the "get" and is free to remarry even if not properly divorced) and invites abuse (extorting money or custody rights for the "get"). Rabbis of long ago were capable of innovating (e.g. the "prosbol") to find a solution to pressing problems. Today, not so much.

16. #12 Joy -- Hebrew, Democratic, Secular State
Michael ,   California, USA   (06.29.11)
Is your get-less sister awaiting your support? I know of a Hebrew, democratic, secular State of Israel. I don't know of any "Jewish land." You are correct, I am not there now, but will be there when needed.
17. no. 13 she has to have it if she wants to get remarried
(06.29.11)
to another man b/c the man needs to see that she is free before he will marry her. and i have a question here. is he refusing to do this b/c he still loves her and can not let go? or is really hates her that much that he would rather rot in jail for it to be over, i submit that he loves her and can not let her go. i was kept agunah for 14 yrs to my ex even though her remarried to a reform woman and refused to give it to me which i submit that he still loves me in some way and can not let go as that is the last vestiage remaining of the ties which bound us together. once a get is given it is forbidden for the couple to ever remarry together. so maybe he thinks one day she will change her mind?
18. Prisons in Israel are like hotels (accd'g to your main news
Essie HaKohane ,   Florida, USA   (06.29.11)

19. #14
TSB ,   Clifton NJ USA   (06.29.11)
Everyone agrees that a get coerced by a Torah Beis Din is valid. The Talmud states so explicitly.
20. Michael, what do you know about radicalism?
American Sabrah   (06.29.11)
You like most irreligious hilonim have no knowledge of Judaism whatsoever and therefore are not in a position to make judgments when it comes to religious matters. A Jew is required to go through the Beit Din and issue a Get to his wife whether he is religious or not.Withholding a Get is very serious. It means that both the wife and the husband cannot remarry unless they have a valid divorce. You left the country to avoid "religious fanaticism" only to face left wing political fanaticism being enforced by the Obama administration. And there are many nut jobs on the left as there are on the right. At least the right is not as nationally suicidal nor they are crippled by political correctness. They self destructive behavior by undermining the morale of Israel is more damaging to this country than the Kachniks. Israel is a Jewish state and it will remain as such.It will never be like Europe as much as you would like it to be.For the record, a government running on socialism is not a democracy. All the progressive secularists did was to ensure a Nanny state by making everyone equally poor and dependent on the government. I, for one consider myself to be more Jewish than Israeli.I was born Jewish first.I only acquired my Israeli citizenship later.
21. We need different law!
Jew1 ,   Ashdod   (06.29.11)
Rabbinical court stood by me when I needed divorce from my abusive husband. They tried to do everything to get me divorce on the day he was ready. The whole court was adjourned for 2 hours and they made papers ready immediately and did the ceremony on the same day. Thanks to them and god that I am free. Even situation in this article is a good step towards the problems women face in this country. But I it ridiculous that a women has to wait till her husband is ready to leave her. We need law like america where if a couple is not staying together more than a year then they are automatically divorced...
22. 18 He belongs in an asylum...
ORA ,   JERUSALEM   (06.29.11)

Are you talking about Uganda, Herzl's dream land for secular zionists?
24. #20 Sabrah, She'll remarry in Cyprus dumping the aberration
Michael ,   California, USA   (06.29.11)
She can go to a justice of peace and get it done in 10 minutes in Cyprus. Marriage by a rabbi is only valid to those who want but not to me and most of Israelis. You see, I am a radical and I really -- surprise, surprise -- don't care for Karl Marx or Lenin or Mao. Also, I don't care for any g. Actually, Karl means more to me than g because he was flesh and blood, not some imaginary hokus-pokus. As to Israel's morale, it is your cronies that are undermining it by not serving, not working, just schnorrering off funds that are needed for the sick who don't get the medicines and the young who don't get enough teachers in the Hinuh Mamlahti schools. Look at yourself in the mirror, sabrah, and view an aberration of Israel. The woman who wants the get looked and saw a partsuf of her Haredi husband, the aberration. She is very, very miserable, but not because she cannot remarry in Cyprus.
25. jewish state or no state
yoni ,   tel aviv   (06.30.11)
either we have a jewish state or there is no justification to having a state of israel at all. jewish law is amazing, complex, deep and God given. if you dont know anything about it go and learn if you dont want to learn go to another country. this is not kansas
26. This man is a hero to YHWH. Why? Rabbi Yeshua said from the
Rivkah   (06.30.11)
beginning there was no divorce but Moses for the hardness of people's hearts, allowed divorce. But from the beginning it was not so. Rabbi Yeshua then said that anyone who divorces his wife and marries another commits adultery and anyone who marries a woman who is divorced causes her to commit adultery. This man is preventing his wife from commiting adultery by marrying another during his lifetime. She can shack up and have mamzerim, but if she gets a divorce and remarries, she commits adultery and the second marriage is adulterous. Adulterers do not enter YHWH's Kingdom. This woman thinks her husband is harming her life when he is protecting her eternal soul and she should kiss his feet for doing so. Separation is all right with YHWH, but divorce is not if one wants to walk the highest paths of YHWH's light.
27. Absurd
Marcelo ,   World   (06.30.11)
Rabbis support the indentity of get, and enforce it by menacing 10 + years in prison for the husband. Why did husband stayed in prison for saying no. It is up to Rabbis to find another way instead of taking husband freedom. This is not judaism, it is extremism. Sorry, I love Israel, but this is something disgusting and worrysome.
28. to 24 Michael
john Darren ,   cairns-Australia   (06.30.11)
You say that Karl means more to you than G-d.You sound like a very angry young man-I don't think that you are at peace with your self. You should do something about it.
29. The man is mentally sick and a control freak
Talula ,   Israel   (06.30.11)
there is absolutely NO other reason for his behaviour. Laws must be changed and this case should be set as the precedent. There is NO way in HELL, that this should be allowed.
30. I agree #21!!! G-D bless!
