Chief Justice Banish should examine the systems in the UK and USA before firing off. The systems in the UK have served the country well for hundreds of years. The legislators set the law and it is signed off by the monarch. It is not challenged by pressure groups, as is done here in Israel, but decided upon as a result of cases brought before the judiciary, hence the term case law. Israel does not have democratic systems as the individual citizen is not represented by a constiuent representative to whom he can request to deal with his case with the goverment. As such the MKs only represent the party, unselected by the electorate. Banish think again!

We would be better off with a new high court that kept out of security and religious issues. And unelected politicians that voice their opinions. Currently, no judge can become a member of the High Court (and its very generous salary) without the Chief Justice approval, so no judge will ever be critical of the Chief Justice, family or friends. Imagine a hypothetical situation where Chief Justice gives his wife a real high paying job and she was really incompetent. Would anyone criticize? Imagine if Chief Justice's son stole money from a local music band. Would any judge find him guilty? Imagine if a close friend of a Chief Justice libeled an innocent man and ruined his career. Would any judge dare rule in favor of the innocent man? The High Court might improve when the judges are elected properly.
