1. The loss of revenue should make up for this fraud.
Henry from New York ,   USA   (02.16.12)
I don't care about the truck, but the same utensils and plates is something else entirely. They could have designated one kitchen as being solely trief, but they just had to mix trief and kasher. Despicable and disgusting behaviour.
2. Thata why there is a Mashgiach meant to be in the kitchen!
Moshe ,   Jerusalem   (02.16.12)
3. God of the Universe, picky eater!
Yoni ,   TLV   (02.16.12)
Humans are just cycling trivialities. To think that a cosmological process that is all-powerful, all-knowing, and all-pervasive, would actually care whether or not you mix meat and cheese is 100% buffoonery. It's a belief that is a product of stupidity, actually. And "tradition" alone isn't enough to justify primitive belief.
4. #3 - Who cares? It's a cultural practice regardless of one's
Henry from New York ,   USA   (02.16.12)
opinion on the matter. If people choose to practice a custom that doesn't harm anyone then who are you to judge? I think the real idea behind it though is that it's kind of a cruel thing to do. The original passage had something to do with boiling a kid in its mother's milk. I count poultry as parve for that reason, because while a calf or kid comes from a mammal, poultry doesn't give milk.
5. Sounds like a bunch of disgruntled ex employees to me
Shosh ,   Jerusalem, Israel   (02.16.12)
This is truly a shame. Morrell caterers have had an excellent reputation for 40 years in NY..I do not believe this story and I do believe that Tom and the chef have other motives and are trying to shakedown Scott Morrell on a separate legal matter by destroying his business. For shame.
6. Hahaha Kosher...its more like nothing today
Al   (02.16.12)
I've been around the food business my entire life. Today' Kosher' is as kosher as pigs feet. Its all about branding and with upteen kosher certifications out there its all bevome a huge business even a fraud. Keep your food simple, local and fresh. Packaged food is crap, stay away from it. Get to know and trust only local kosher butchers who buy their products locally and who have high turnover. It may be a bit more expensive but it is more kosher and of better quality. The big grocery chains sell repackaged garbage which is wraped in plastic for who knows how long. The meat in these packages turn pasty amd moldy.. Meat needs to breath. Milk is milk. Bacause of mad cow disease of the mid 90's most foods today do not use animal fats or oils in their production. Its all vegtable oils, thus more people in NA today are overweight. They eat lots of processed 'kosher' foods all day long. In my youth, my late mother followed the simple rules of kosher and we were rail thin and healthy. Today the kosher mothers feed their kids crap and they end up looking like crap
7. something's not quite right
tom ,   toronto, canada   (02.16.12)
a kosher caterer doing non-kosher events? that doesn't sound like a good idea at all. where was the mashgiah in all of this?
8. #3: if the charges are true, a fraud has been perpetrated
rick ,   walnut creek   (02.16.12)
if the charges are true, and this will be determined, it would not make a difference what the misrepresentation was, as long as there was a misreprenstation, the caterer would have committed a wrong. for example, IF the caterer FALSELY claimed that all its meals were vegetarian or dairy or gluten-free or made from organic ingredients, the defrauded consumer would have rights and remedies recognized by the law. #3's anti-religious bias has confused him and made him unable to understand the issue. SMARTEN UP.
9. If they so want to eat kosher, they have to live in Israel
Yossef   (02.16.12)
10. In Jewish law two witnesses ...
ORA ,   JERUSALEM   (02.16.12)
are needed to take in account accusations. One witness is considered as slander.
11. #8 - Actually, I think there was a similar case and it was
Henry from New York ,   USA   (02.16.12)
thrown out. If I remember correctly, the court found that it couldn't do anything as punishing the defendent on the basis of kashrut would have been seen as an endorsement of a religious law and a violation of separation of church and state. (Sorry about the run-on)
12. no problem with cooking...
golan ,   modiin   (02.16.12)
kosher and non-kosher foods in the same kitchen as long as the oven, the dishes, the utensils are cleaned and kashered before used again for kosher stuff. In my father's home he has kosher utensils and taref utensils. a self cleaning oven (x2) ect.
13. More to this story than meets the eye
Kyle ,   Southpark, CO, USA   (02.16.12)
As more information comes out, it is looking more and more like an attempt to drive this caterer out of business by submitting bogus accusations. The complaints have been traced to a disgruntled former business associate, there is actually no evidence to support them.
14. Mas cgiach fee
(02.16.12)
So why does one pay the $300 masgiach fee if they dont monitor the kitchens? Talk about a racket.
15. #12 - That only works with metal and glass dishes though.
Henry from New York ,   USA   (02.16.12)
I don't think you can make china and porcelain kasher once it has become treif.
16. Not enough evidence to pass judgment
Ezra ,   US-ISRAEL   (02.16.12)
We should wait until the trial or hearings before casting stones. It's not the first time such a thing happened if it is true however. NY has had it's share of insane behavior in the kosher world. And yes, it was always about money. Sadly. As usual with the Ill behavior of humans. Wait and see here though: no one has provided any evidence as of yet so judging is foolish. Shalom.
17. #11: wrong! irrespective of collateral...
rick ,   walnut creek   (02.16.12)
irrespective of collateral issues, if one knowingly makes false representations to a consumer, which are designed to and do, in fact, induce reliance, to the detriment of the consumer, a fraud has been perpetrated. it is irrelevant that, because of what it viewed as constitutional constraints, one particular American court, seated in a particular locality, felt constrained to decline to hear the case.
18. #17 - I looked up the relevant case just now.
Henry from New York ,   USA   (02.17.12)
Commack Self-Serv. Kosher Meats, Inc. v. Weiss - This was in a federal appeals court and could be cited for future cases thanks to our law being based on Case Law. It can also be overturned, thankfully. It found that certain parts of our state's "Kosher Fraud Law" were unconstitutional for the reasons I stated in my earlier post. This has also happened in the New Jersey Supreme Court, apparently.
19. @ Al
Angry Clown   (02.17.12)
Hold up. Your trying to sell that animal fat/oil is more healthy than vegetable oil? Would you mind explaining that one scientifically to me, because anecdotes just don't cut it.
20. Addendum to 18
Henry from New York ,   USA   (02.17.12)
All courts within the 2nd Circuit - New York, Connecticut and Vermont courts - would be required to abide by the decision of that court. However, other Circuit-level appeals courts could contradict the 2nd Circuit. I can't think of a valid argument they could have against the ruling sadly.
21. Not everything can be "kashered"
Charles ,   Petach Tikva   (02.17.12)
Knives for example can , but only if they are made in ONE piece so that nothing can come in a space between two parts . Some say that china can , porcelan not . But selling non kosher food as being kosher should be treated as a fraud . If the justice can't do it , then the rabbis should intervene and not give them a kosher hechscher anymore .
22. #21 - spot on!
Henry from New York ,   USA   (02.17.12)
The hechsher approach seems to be the only possible one here though as the New York Kosher Fraud Law was ruled unconstitutional by that case I cited.
