31. Then no one has to sing the anthem
Ilan   (03.01.12)
Never heard of a rule of law where only certain citizens are obligated to do something. And not singing the anthem, not listening to women sing, or be forced to look at immodest dress are all of equal validity. There is a word for letting everyone do as he or she pleases: anarchy.
32. to #10 you can say the same on Turks
ghostq   (03.01.12)
in Germany, will Germany change the national anthem in order to apease the Turkish minority, the answer is Naturaly Ne.
33. #32 I'm not so sure about that :-(

34. #32 German Anthem
Jeff ,   S.A. USA   (03.01.12)
...you are so right, the german anthem says"... to the german fatherland" and all the german turks sing it!
35. #10 ghostq
solomon ,   bklyn   (03.01.12)
The word “Jewish” is a religious one. Nowhere in the German national anthem is the word "Christian" written or any reference to religion. Your example is not a good one.
36. Rubinstein's Message: Loyalty to Israel is NOT Required
Linda Rivera ,   New York, USA   (03.01.12)
Loyalty to Israel is NOT required to serve on the Supreme Court. The decisions you make as a Supreme Court Judge based on your DISLOYALTY to Israel is ACCEPTABLE. The Koran commands Muslims to conquer ALL nations and subjugate despised, hated non-Muslims under excessively cruel Islamic sharia law where defenseless non-Muslims have NO human rights.

38. can't identify with the lyrics?
naomi ,   israel   (03.01.12)
citizenship and a judgeship (for goodness sakes) should only be granted to those who can identify with the lyrics of the Jewish State of Israel.
39. anybody who is not willing to sing Athemn
(03.01.12)
Has to be given oportunity to leave Country as a part of Human Right. Assistance should be provided and goverment comity should be set. Some nobile persons like this Juge should be given priority.
40. of course they don't!
les ,   canada   (03.01.12)
they have absolutly nothing to do with israel. most of them are just there to freeload on the state, take all they can, in the mean time hurt the country and the jewish people any way they can! and if at nothing else, in that they are pretty good at!
41. Which prophet wrote this in 1981????
Besalel ,   Great Neck, NY   (03.01.12)
"""When the Israeli Arab is told to rise for his national anthem, “Hatikvah” (the hope), and sing of “the Jewish soul yearning” and “the hope of 2,000 years,” can he be expected to feel empathy? Indeed, Israel’s resident self-hater, Uri Avnery, proposed in 1975 to change the anthem. His reason made eminently good sense if you were an anti-Zionist: the song’s motif of Jewish longing for Israel is not acceptable to Israel’s Arabs. When the Israeli Arabs looks upon the happy revelers on Israeli Independence Day, celebrating, in effect, the Arab defeat and the displacement of an Arab majority of Palestine by a Jewish majority of Israel, can he be seriously expected to join us? When, in the words of the Independence of Independence, the Law of Return opens the gates “for Jewish immigration,” and not Arab influx, for the cousins of the residents of Tel Aviv and not those of Nazareth, is it surprising that the Arab feels alienated from the state? The concept “Jewish” is dinned into the Arab’s angry head every day. Well, he is not Jewish, and what perverse madness prevents us from understanding his alienation and rage? Has it never occurred to anyone that the very existence of a Jewish state in the land where the Arab was once the majority makes him uncomfortable and that is unacceptable to him?"""
42. To all those who believe Joubran should have sung
Ehud   (03.01.12)
Why not asking women to join in the prayer "shah lo assani isha" (Blessed be You, Almighty, who did not make me a woman). Same logic!
43. \Linda , 36 . Judge Joubran is Christian !
Charles ,   Petach Tikva   (03.01.12)
not muslim , and a very loyal citizen of the State . There are many LOYAL non Jews who serve the state , the Druze as an example , who serve in the IDF , had many of them killed in our wars . They at least live here , not in NY .
44. The Israeli Anthem
John ,   Hamilton, ON   (03.01.12)
The Israeli Anthem is a Jewish anthem. Why should a non-Jew believe in or sing it? "In the Jewish heart a Jewish spirit still sings, And the eyes look east toward Zion Our hope is not lost, Our hope of two thousand years, To be a free nation in our land, In the land of Zion and Jerusalem" Maybe if this so-called "national" anthem was all inclusive there would be no problem for non-Jews - Israeli Arabs, Christians, agnostics and atheists, etc. who are Israeli NATIONALS.
45. A citizen of Israel, but NOT Israeli
David N. ,   Haifa, ISRAEL   (03.01.12)
Being a citizen of Israel, and being an Israeli, are not not the same. This is NOT essentially a technical or legal matter. It is a lot deeper and more profound than to retort, "but if he's a citizen of Israel then he is an Israeli." If so, then the very definition of "Israeli" is different for him than for myself. Many Arabs in Israel have said that while they are citizens of Israel, their nationality is Palestinian. For me, being Israeli is my Jewish citizenship, my Jewish nationality, my Jewish identity, my Jewish destiny. Christians should have no trouble taking joy in the fulfillment of prophecies in a book they claim to believe, and putting Arab ethnicity in second place to their Faith. Even a Muslim has the Quran to site for this Land being given to the Jews. No, this sour grapes of Arabs who cannot take joy in being a happy, prosperous minority is not ok. They decided to fight and they lost. They'll never know what they lost. But they can call themselves Syrians again as they did when we Jews were the Palestinians.

I disagree with the others. And I never thought of those in the IDF: thank you for that reminder. Interesting, that many posts still villify the judge but make no mention of those brave souls in the IDF. To sing "Nefesh Yehudi homiyah" (A JEWISH spirit still sings) when you are not Jewish? The word is NOT “Israeli”. Others speak as if Jewish and Israeli are the same; they are not, and for him they certainly are not. The posts speak of politics, but the word “Jewish” is a religious one. Calling it an anthem does not change the religious connotation of the word "Jew". I am proud of that word. But I see no reason for someone who is not a Jew to sing it or even say it as if it applies to himself. If I happen to be at a friend’s Christian ceremony, such as a wedding, and we are asked to rise, I will stand out of respect. If the [Christian] Lord’s Prayer is recited, I will stay silent. But I will continue standing out of respect. The same respect that Judaism is accorded when a non Jewish friend might accompany me to the synagogue ‘to see what it’s like’; I expect my friend to stand when we stand but not necessarily to say the prayers. The judge upholds the laws of the State, does not speak against the State, and is not involved in the 'politics' of arab members of the Knesset. He stood out of respect for the State and does not speak ill of it. You speak of politics, but the word is a religious one. There is a world of difference between the two. (Republican or Monarchist, this is political, not religious.) And calling it a national anthem does not turn "Jew" into a nationalist word, especially when there is the nationalist word "Israeli". Religion is deeper than nationality, as we Jews well know, after having been martyred for our religion, not nationality, and we should be sensitive to this.

48. TANAKH nationality, Faith and Land and Peoplehood
David N. ,   Haifa, ISRAEL   (03.02.12)
Seperating "Israeli" and "Jewish" is a modern innovation. "Jew" and "Jewish" are frankly not part of our Torah heritage. We are a people, a Faith, and we have a Nationality and a Land. ALL together--not just nationality, but a nationality based on peoplehood and a Covenant of the Land. Our spirituality and our nationality and our peoplehood and our faith are intertwined clearly all over the Tanakh. The minute one says "Israeli" has nothing to do with our Faith, I am dismayed. I do NOT refer to some modern, secular, gentile definition of nationality, but the one that defines us as a distinct people in a distinct God-given land, and of a distinct God-given faith, THE FAITH OF ISRAEL, which is not so narrow as many modern concepts of "Judaism." Being a Jew is a lot deeper than religion--as we Jews well know, having been martyred for a lot more than just religion. We have been martyred for our Faith, and our Peoplehood, and our dogged nationality defined by the Covenant of the Land. ALL of those things. Gola, diaspora are not called exile for nothing! Many Arabs in Israel say that they are Palestinian in nationality, though citizens of Israel--thus claiming not to derive nationality from Israeliness at all. So much ordinary and shallow use of words and definitions here!

You've said what I've been trying to say, but better and in fewer words. Thank you.
50. Who jCares.
Douglas Fireman ,   Chicago, USA   (03.04.12)
Who cares. There's other more important things to deal with than the Israeli National Anthem- like finding a road toward peace. In the meantime, the judge and anyone who chooses to can remain silent.
