My understanding of how Goverment works is that there is a PRIME Minister and then below him just regular ministers. Barak is just a regular (albeit irregular) minister. Israel is a temporary military occupier there. Occupiers are, since 1947, prohibited from seizing occupied land or settling their own people on it, this being the world's harsh legal reaction to the German's colonial adventures of WW2. All 121 Jewish settlements in the occupied territory are accordingly illegal and will require to be vacated.
