Canada's Charter of Rights and Freedoms has a notwithstanding clause which allows for the possibility of legislation which would be normally unconstitutional but which would be legal for 5 years & then would have to be passed again or be allowed to lapse.

With their frequent unlawful decisions overriding elected representatives of the people laws they caused this to happen. If they were much more restrained like in the US with Obamacare, which is a clear violation of the American constitution, the Knesset would not have initiated such a law.

The courts have been butting in to much and overthrowing government policies so something needs to be done but at the same time there must be an independent body to control the MKS otherwise we risk an elected dictatorship where the government tells the court you object what we do tough we can overrule you allowing governments to do whatever they like unchecked.

Lovely concept. Of course you do realize, however, that the State of Israel does not have a Constitution. So there really is no place for judicial activism in Israel. It is the role of the Knesset to make law. It is not the role of the judiciary.

You rarely get a true majority (not of the voting MK's, but the full plenum) for anything, so the clear support by 61 MK's (which would implicitly include preferences of other voters that did not result in an elected MK) is "Feeble"? I don't think so. * If there is a problem, mandate a required vote (no abstentions) by MK's; * If there is a problem, make overriding the SC requiring a super majority of 75, or even 80. These SC decisions are "Tyranny of the minority".
