Court rejects petition by Susiya residents against fence route

The High Court of Justice rejected a petition filed by residents of the Jewish settlement of Susiya south of Mount Hebron against the fence route planned in their area, which excludes their community from Israeli territory.

 

Judges Aharon Barak, Dorit Beinish and Eliezer Rivlin reasoned that the interests of Palestinian residents outweighed the settlers' claims in this particular case. In the verdict, the judges wrote: “The security considerations of the settlement, its residents and visitors are only one part of the total considerations weighed by the military command. We were convinced that the military command made a balanced decision between security needs, and the rights of both Israeli and Palestinian civilians.” (Aviram Zino)
