High Court blasts State over Ulpana petition

Court says State's motion for delay of Beit El neighborhood's eviction lacks legal merit. 'When the PM commits to something, we expect it to get done' judge chides

The High Court leveled harsh criticism at the State Sunday, blasting its attempt to postpone the eviction of the Ulpana neighborhood, in the West Bank settlement of Beit El.

 

Residents of Ulpana were set to be evicted on May 1, but the court order was not enforced.

"You're basically seeking to change your policy post-verdict. This is unheard of," Justice Uzi Vogelman said during the hearing, which focused on the State's petition to postpone the eviction by three months.

"When the State say it intends on doing something and the prime minister commits to it, we don't consider a scenario in which it doesn't get done. There is mutual respect between the authorities," he said.

 

"I still don't understand the State's legal grounds here. You want to review a closed case. This is unprecedented.

 

"The State's commitment was made following an interim order. This was not a voluntary commitment… will every ruling lead to the State asking to review the case again? Where will all this end?"

 

Justice Salim Joubran added that "The State has made a habit out of filing petitions asking for exemptions… what have you been doing for the past year? Perhaps you never meant to honor your obligations? "This is very unhealthy judicially, he concluded."
