B"H Is she saying that Jews have a moral obligation to not live in Israel? What is the moral stain exactly of Jews living peacefully in their land? I do not buy this stolen property thing after the Arabs fired up the synnagogues in Gaza, showing who the real theives, vandals, and occupiers are. These were once pure sands without any Arab settlement whatsoever. And that same was applied there even so. Is it that Arabs will complain of olive tree prunings? Is this the great moral stain? Is it roadblocks, that are positioned as all for the setttlers when in fact essential for Israel proper's security? I think the moral stain is allowing such a character to make such hooplah by staining the characters of very noble people.

Civil administrations do not have an exclusive obligation to the Palestinians, per se, as a national group - that's the kind of mandate the UNWRA gets, and it's worth clarifying what civil administrations are for vs. what the UNWRA is for. Civil administrations govern in the absence of local government, and one of these functions is land management. Under Ottoman law (which ruled when deeds for these properties were alleged to have been secured) and generally accepted common law worldwide, lands that are abandoned or do not have clear title become lands of the civil authority, who is obligated to utilize these lands in ways that improve the general welfare of the inhabitants. Any Arab knows that they can stop such declarations by producing such documentation, and one can only gather that they don't own the property if the government was able to declare the land "government land". The general welfare test does not include protecting national interests that post-date the civil administration, especially of terrorist groups that seek nothing but Israel's harm. Rather, it should be adjudged solely as whether the inhabitants benefit from the infrastructure and work that the decisions of the civil administration provides and in this regard there is no moral stain at all. Before the intifada, Arabs were much poorer, less literate and healthy than they are now. The intifadeh, not "occupation" is the cause of the problems. The only way to resolve the conflict between the bundle of rights that Israel had prior to recent changes in international law that encourage the establishment of a Palestinian state, and the bundle that Palestinians have been given at the expense of Jewish claims to the heart of their homeland, is negotiations, and for the Pals to act like a state and keep their promises. Otherwise, "blatant violations" of law will be the least of this judge's worries.
