Wonderful! Israel frees murderers and extends a friendly hand to her neighbors. What does Israel get in return? More incitement, more terrorism, more rockets thrown at her. How many Israeli prisoners have been released to Israel by the Arabs? The Arabs kidnap Israeli citizens and then demand ransom for their release. But what condition are they in if they are even released at all. They certainly do not receive good food and shelter and they are most likely tortured - a favorite Arab passtime.

For our great leaders, sensitive judges,who again showed how much they care for our childeren in the IDF. A fine example we are for a light among the nations. Anyone feeling pride to be a israeli needs to have his head checked. What a farce this state has become, meanwhile there is some twisted way of thinking that this will buy us goodwill in the world. Next suggestion will be that we all get palestinian pasports again. Long live our secular democraic zionist state.

This "chicken government" and ALL the "chicken governments" before it tow cow to the Supreme Court Bench which opposes the introduction of minimum sentences. Some even allege that Haim Ramon was "set up" because he wanted to institute judicial reform. Whether it is this case or the case of Dr. Gonen Segev serving 19 months for smuggling 30,000 Ecstasy tablets into Israel, or Attorney Avigdor 'Dori' Klagsbald being sentenced to 15 months and serving one third for the killing of a mother and her child in a traffic "accident" while under the influence of alcohol, the system is a disgrace. Yesterday, 4 July, a young adult was sentenced to 5 years imprisonment for killing 3 of his friends in a road accident near Akko. If he behaves he will serve one third! That is NOT justice! I agree, the young guy is contrite and shows remorse but he KILLED three young guys and smashed the lives of their families and his own family! Add to this the disgraceful handling of the Shomrat Rape case by our esteemed State Comptroller, Micha Lindenstrauss, then a judge, when he freed the 6 defendants after saying "the six acted "like beasts," but, on the other hand, the girl wasn't entirely credible, so he had to let them go.” This is the Israeli Judicial System and the Chief Justice has the gall to criticize criticism of it. Judges, politicians and civil servants have forgotten that they are PAID by the public to serve the public and NOT their own interests!

You're right that, within a war, combatants can not be killed or sued for killing combatants. However, a combatant is defined by the Geneva Convention (Common Article 3) as someone openly bearing arms, having distinctive, recognizable insignia, having a command structure and openly abiding by the rules of war. Although Jordan and Israel did not have peace at the time of the attack, the men were not part of the Jordanian army, which does adhere to the four above-mentioned rules. Therefore, they were criminals, not legal combatants. As such, they can be sued as killers, which they were. According to the Geneva Conventions (which, notably, were written at a time when terrorism and guerrilla groups were not a common phenomenon like they are today) there is no category to define illegal combatants (those who are clearly hostile and armed, but don't fulfill all four of the categories stated above). Because of the dichotomy of civilian and combatant, a 'civilian' is defined, ambiguously, merely by virtue of not being a combatant. Firstly, such a definition of civilian has been acknowledged by the legal community as problematic. However, even if we don't take Geneva's simplistic dichotomy to task, a CIVILIAN who is ENGAGING IN HOSTILITIES can legally be TARGETED according to int'l law (which is what Israel does when it targets gunmen, rocket launchers, etc). FURTHERMORE, int'l law does not prohibit the accidental killing of civilians, even in cases where it is known in advance that some civilians MAY be killed due to their proximity to a legitimate target. The legality is judged by the proportionality of the damage. MOST IMPORTANTLY, in determining whether military actions are war crimes, INTENT is one of the main factors considered (a factor that you ignore consistently in your posts, in your erroneous attempt to conflate the IDF with Islamic extremist groups). As such, your attempt to criminalize the IDF is unsubstantiated by the very laws you attempt to throw around bombastically only at Israel and at no other nation.

Because these men killed Israelis they are heroes, but if they had killed a Jordanian solider then they would never have lived long enough to stand trial. Because we have very little national pride we can release these people where they will be lauded as heroes within a very short time. How do we expect our enemies to respect the lives of our citizens when our own government and court system consider us as no more than sheep to be slaughtered?
