It's all politics as the court will intervene to set the route of the fence or annul decisions that it feels violates rights. Here it is clear that the release harms the rights of victims to see their persecutors serve their full terms, but since it is a "peace" move it gets a pass.

I do have the right to ask my government why they are making this decision, what value it has and who it will help. But apart from that I do not have any special expertise that assists me in second guessing the government in order to make the correct decision. I have never seen personal loss and grief listed as requirements for making State decisions.
