There are different groups of people to consider and the laws applicable to them should be different: citizens, traitors, foreigners. 1) The death penalty for citizens is a civil debate and ultimately becomes a question of a trade-off between safety and certainty, ethics and the power of government over its citizens. 2) Traitors should be shot. There exists a social contract between a country and its citizens. Treachery resulting in death, or severe consequence to the country as a whole, can be seen as a hostile end of this contract. Mild treachery is also an end of this contract, but should be dealt with by exile. 3) As a rule foreigners should be executed. There exists no social contract between them and the country. The exceptions are if their home countries are allies in which case it becomes a diplomatic issue. If their home countries are not allies just shoot them. #7 By extermination you imply that it is immoral to kill of a group based on their ethnicity, heritage or place of origin. However "terrorist" is neither of these. In modern society it is unacceptable to discriminate based on race, religion or origin, but it is certainly desirable to discriminate based on useful criterion such as danger, hostility and action.
