In previous wars, especially the first Lebanon, there was time for introspection on apart of not only the Israeli public, but the government as well. What has changed? Does the Israeli gov't not realize that maybe they should inquire into these charges, again not only by 3rd party observers, but also by Israeli soldiers themselves who were there? Are they lying and fabricating too?? Answering back that the US does this in Iraq and Afghanistan similar to Yonit Levi the other night on Channel Two, is not the answer. Israeli soldiers are indoctrinated that ALL Palestinians, not only the terrorists and resistance fighters, are animals and not worthy of life, and because of this the most "moral" army has recently lost it's way in conducting it's operations. No one can excuse those who fire rockets from houses, hospitals and cemetaries, but there is no justifciation either to drop white phoshorus knowing there are civilians in the area, as well as specifically targeting sewage treatment facilities with two tonne bombs. It is not balanced whatsoever. The only time an enemy country dropped bombs of that magnitude on Israel was in 1991, to which there was no response just a pay-off.

That would be like if someone wrote a report on WWII and decided to equate the soldiers killed in battle to the Jews slaughtered in concentration camps. You can mention them together all you want but it doesn't make a comparison of the casualties legitimate. This article is simply wrong.

5. The report ignores the reasons for Israels behaviour

The report ignores the reasons for the way Israeli troops behave in that way for example - "the story of the Abu-Khalima family: A phosphorous shell was fired at their home". Yes - these things happen in war - perhaps a terrorist was seeking to hide there or perhaps it was just a mistake. "Five people died on the spot, including four children aged 14, 12, 8, and a year-and-a-half. Other people were wounded". Collateral damage - it happens to all armies. In WW2 the Americans and British bombed German cities and caused many more deaths - why is only Israel being singled out of all the other nations - recently in all wars these things happen - "The IDF did not allow an ambulance to evacuate the dead and wounded, and also removed them from the vehicles they traveled in to the hospital as it fired and killed more relatives who survived the initial bombing". Again - we know that the Palestinian terrorists use all kind of tactics to kill Israeli soldiers and civilians - without knowing the reasons of the commander who ordered the shot, how can one say it was a war crime. Just because there is collateral damage does not mean a war crime was committed - sure its terrible and we don't want to do this - but lets face it the real cause is the Palestinian Hamas terrorists that continue to use their own people as human shields! If you are going to accuse Israel for this - you should lay these charges against all nations who engage in war USA, Russia, Britian - the fact that we are singled out proves its anti-semitic

Well I am busy wading through it (320/576). 1. It is vehnamently ant-Israel in tone-not what you'd expect for international justice report. 2. Nonsensically defends Hamas's actions and says no weapons in mosques, schools, zoos, hospitals etc. 3. Comes up with stories that IL has refuted with u-tube videos - Hamas propaganda (remeber Mohumad Al Dura?) This report is dangerous and ANY defense of it makes a mockery of the word justice as it is full of lies and heresay. Read it for yourself.

... you find that it's deeply slanted and poisonously targeted at Israel. The words about Hamas are a mere fig leaf, whereas the vast bulk of the report targets Israel. It ignores conflicting testimony, fails to verify Palestinian claims, fails to mention critical factors such as the identity of Hamas fighters among supposed civilians, espouses legally invalid definitions of key terms, etc. See the blog at elderofziyyon.blogspot.com for an ongoing fisk of the report.

Goldstone was interviewing gazans while ignoring family doctor who still suffer from rocket shock she got fragments of her still stuck in her body. he is sucrifing his own people wile sitting far far away in cosy place, I this writer of the article to live one year in sderot and hear the sirens to realize he is not correct I can bet my money this writer live far away from sderot and will not contribute to save his own fellow country people. On what basis are we to respect Gross's statement that "the fact (sic) that Israel too kills many civilians" I don't see a Gross quantification of acceptable number of civilians IN CONTEXT. Gross, we take your comments as politics sans any semblance of science. If you pontificate in an academic vacuum about acceptable military practice, you are doomed to the confines of that vacuum. Neither you nor Goldstone are in possession of facts that would allow you to comment with any degree of credibility.

Israeli soldiers are taught precisely the opposite. The "Israeli soldiers who were there", as you call them, refused to press charges in military courts against people whom they say are criminals, but rather went to highly political anti-Israel groups and gleefully published claims that are otherwise wholly unsubstantiated. If they know of criminal behavior, these "soldiers" are OBLIGATED under Israeli law and IDF rules to stand forward and bring it to the attention of commanding officers. But they didn't. The claims that HAVE been investigated turned out to be cases where someone heard that something happened in a different unit, but what actually happened was radically different from the flawed rumor. But you won't learn about this by reading this piece of propaganda. Actually, there IS a reason for using white phosphorus, so long as one does not use it as a WEAPON. White phosphorus is used by militaries all over the world to create a smoke screen. That is how Israel uses it too. Sewage treatment facilities were not "specifically targeted;" Hamas terrorists were. If Hamas was launching rockets from sewage treatment facilities, these became military targets according to international law, and specifically eligible for bombing. If Hamas chooses to endanger Gazan civilians, that is Hamas' decision, not that of Israel. Stick to the truth.

Absolutely astounding that a professor of international law can be so ignorant. Gross quotes "We found no evidence of any system of public monitoring or accountability for serious violations of international humanitarian law and human rights law set by the Gaza authorities." Gross simply ignores this fact: Palestinians do not recognize nor adhere to international human rights laws. In fact, Goldstone's concluded explicitly in the report "This indicates the commission of an indiscriminate attack on the civilian population of southern Israel, a war crime, and may amount to crimes against humanity." Gross is guilty of the double standard - there is nobody holding up a mirror before the Palestinians and calling a spade a spade. The Palestinians are guilty of war crimes as Goldstone concluded, and the only possible outcome is to demand that Palestinian leaders be put on trial at the International Court of Justice. Gross missed the obvious: 8 years of continuous war crimes led to a war. Don't treat the symptoms, treat the cause. And that cause is Palestinian war crimes.

IN you article you begin by saying the Goldstone Report is balanced and then get into some guilty/hand wringing, galus jew stuff. You say the report cr9iticizes Hamas and quote: "We found no evidence of any system of public monitoring or accountability [by Hamas] for serious violations of international humanitarian law and human rights law set by the Gaza authorities." This quote alone shows the report's bias. It seeks to separate the shelling of Israel from Hamas, pretending that Hamas is not responsible for organizing this shelling which is a violation of international law. Unless Goldstone first acknowledges truthfully what is going on, how can he be even handed. Is he really calling on Hamas to investigate iots official policies? The mirror you refer to is warped.

Israel just killed 3 gazans who were allegedly about to fire rockets into israel. Three other gazans were seriously injured.I call on goldstone to investigate and report possible israel war crimes and crimes against humanity. Even though the hamas trio were in the car, the other 3 were civilians and should not have been touched. Surely israel could have made an accurate assesement. As for the missiles,t hey are not very accurate so the harm to israel potentially would be small. The main thing for goldstone is to protect gazan civilians, and it is obvious to goldstone that the 23 civilians had nothing to do with the hamas soldiers. You know what an ignoramus Goldstone is-look in the dictionary under the word ignormanus.He is a lamb going to the slaughter. Well goldstone, what comes around goes around-look at what happened to sharon, next olmert in the dock today and looking at jail time. You are next!

Let me fire 12,000 rockets at Toronto and see how you like it. On 7 Dec 1941 3,300 Americans were killed by the Japanese Navy. There was no threat to America since Hawaii at the time was not an American state. In return the US killed over 1 million Japanese. According to your logic that means the US overreacted right? If they want peace then they shouldn't attack us. The UN Charter gives us the right to respond anyway we want.

It is nothing but a footnote though. Think of it this way: what if there was a UN investigation for EVERY SINGLE rocket launch since 2001, and 2-3 paragraphs about Israel's anti-terror ops? Does Eyal Gross have any idea what it means to live in a society without free speech? Can he even imagine that the Abu-Khalima family who gave their heart felt accounts of their tragedy would not have been allowed to give exonerating details? We cannot tell from the report what happened to them and we are unlikely ever to know. As someone who teaches in a law school, Gross should know something about evidence given by people whose lives would be in danger for speaking otherwise.

And this goes on day by day, month by mont, year after year. Fortunately for you, he's no marksman, so nobody in your home has been injured - yet. So, applying your logic (or lack of it), you should do NOTHING about it, because there are no dead - yet. Aren't you forgetting something important? HE IS ATTACKING YOU! Someday he might get lucky and shoot your wife, or one of your children. Will you wait until that happens to react? Would be dumb, isn't it? And for a country in Israel's position, it would be suicidal. So spare me the nonsense of "proporcionality"!

Goldstone's even-handed and thorough report is being widely applauded, and reportedly provides grounds for further investigation into possible war crimes. An issue that has yet to be addressed, but will be a further embarrassment to Israel when it is raised, is this: why has Israel never deployed the laser-guided anti-missile / anti-mortar weapons systems routinely used by the U.S. in Iraq, and which Israel itself has developed? The answer will cast suspicion on Israel's real strategy against Gaza: Are you truly concerned about fully protective defense -- or did you demur on the anti-missile shield, primarily because you wanted to invade Gaza and add to the Palestinians' personal misery?
