Oh, dearie dearie me. Can't begin to imagine the size of the lawsuits to be filed against Hamas. All those suicide bombings. The kidnapping of an innocent Israeli soldier -- Gilad Shalit. Oh my goodness. I don't think Hamas has enough cash to sustain lawsuits for the suicide bombings, which have been considerable. My oh my oh my. Lawsuits? By Gazans? Do they have any idea what is about to fall upon their idiot heads? Probably not. Watch what comes your way. Snicker. Take that, idiots!

From the "assistance" money of course. EU and USA pass billions to the PA on a yearly basis. Some of that money should be channeled to cover the said punitive damages. Since gazans supported rocket fire and suicide bombing, then if they were directly targetted, they had it coming. Thank you goldstone for endangering the jewish people if they did not have enough on their plate with their emotional erdogan, nazi ahamadinejad, satanic and lying assad and twin terror brotherhood of hamas and hizbollah courtesy of olmert and livni. The reason they can sue and will win is written in the fifth paragraph. The "Israeli Court of High Justice" under Aharon Barak allowed them to sue. Until Israeli judges aren't either forced to follow the laws of the Knesset or if they write laws to accept personal, financial and criminal liability, this is what happens.

Israel has more than enough grounds for many, many lawsuits against Hamas, Islamic Jihad, Fatah, the Palestinian Authority, Hizbullah, Syria, Iran and so on. These parties have financed, planned and carried out thousands of terrorist attacks, which have caused much death and destruction. We have got plenty to sue for. These groups and countries could easily be defendants in thousands of wrongful death cases. They have been responsible for millions if not billions in property damage. They have caused much pain and suffering in Sderot through rocket attacks. If the Arabs want to file lawsuits, fine, they can file lawsuits. But they better be prepared for Israel to do the same.

The main purpose behind all this is for Hamas PR. They know how to milk the world "guilt" complex. Israel just happens to stink when it comes to PR. That being said, if Israel reciprocated in kind and laid a claim to the billions of aid being sent in, well it might change the climate somewhat. If it was under our control there would be a lot less attacks from it. The WB is only partly under our control, and look at the difference. Remember, Israel forcefully evacuated all it's citizens from Gaza? More's the pity.

Israel's Supreme Court seems to be in need of a lesson in liberal democracy. In democracies we have a doctrine called the separation of powers, whereby no branch of government infringes upon the powers of another. Any first-year law student in any common law country, especially England or Australia (less so the US), could tell you that the role of the judiciary is to GIVE EFFECT TO THE LAWS OF THE PARLIAMENT, NOT to legislate, or to override legislation despite the clear, unambiguous, express intention of the parliament. I understand the need for an activist Supreme Court in Israel. As a country which has been in a constant state of war, protection of democracy cannot be entrusted to the angry whims of the masses. The Courts play an important role in this respect. But this has simply gone too far in Israel. By what right does the Supreme Court and the retired President Barak decide to attach constitutional ascendancy to Israel's Basic Laws? By what right do the (unelected) courts, without the express approval of Parliament, simply rule that they have essentially unlimited power to strike down "unconstitutional" legislation? This is absurd! Our common law system has built-in mechanisms to ensure that our fundamental rights are protected e.g. a strong rebuttable presumption that Parliament does not intend to legislate in a way that infringes upon our rights. But where that presumption is rebutted by the clear, unambiguous, express words of the statute WHAT RIGHT DOES THE SUPREME COURT HAVE TO OVERRULE THE PARLIAMENT? With all due respect to the Supreme Court, somebody needs a refresher on the doctrine of parliamentary supremacy, which is (ostensibly) incorporated into Israeli constitutional law. Israel's parliament should face no difficulty whatever in passing a law with retroactive operation to either limit or entirely exclude any liability to any persons in Gaza for any loss suffered during Operation Cast Lead. The Courts should not interfere.

Until now, every retribution for IDF strikes were suicide bombers, stabbings and other "benign" (copyright by western intellectuals) cases of "desperate and only possible measures". Eight years of kassam rockets and bombs damaging homes, businesses, hospitals, schools, restaurants, roads etc. Factor in death claims, physical and mental disability, long-term care for orphans and dependents of these bombings, liability claims for damage to buildings, loss of earnings, replacement of contents. These attacks by Hamas were unprovoked and directed at civilians. Israel's response was provoked and defensive. The majority of the fatalities in Gaza were Hamas operatives who hid behind civilians. Israel can withhold some of the money from taxes owed to the Palestinians. Hamas leaders can fund repayment, the UN can be drawn in for not stopping the terror attacks and private Gaza families can be sued, particularly the ones who received money for weapons smuggling tunnels to be built under their homes.
