Legally, one looks to intent. Just because the missiles caused no damage or loss of life does not mean that they weren't intended to cause damage. If someone attempts to rob your house, but doesn't because he was thwarted or because he was inept and did not realize that a silent alarm rang in a police station somewhere, does not in any way mitigate the fact that he INTENDED to rob your house.
