Israel is at war, with Hamas/Aza in actual terms and technically with most Arab nations who attacked Israel in 1948 and who have not subsequently signed a peace agreement. Therefore, citizens of those Arab countries should be held as POWs. As far as citizens of other countries are concerned, they were aiding Hamas in its war for the destruction of Israel and should be charged accordingly. Of course, if Hamas want to do a prisoner swap, they can have all of these POWs in exchange for Gilad Shalit.
