Mashaal is wrong. Gilad Shali is not just like Palestinian prisoners( in Israeli jails) who have visits from the Red Cross & their families. Gilad Shalit has never had a visit from the Red Cross nor his family.

Israel should declare Shalit K.I.A. and refuse to negotiate anything based on whether he might be alive. Any conversation that Hamas ever raises with the name Gilad Shalit in it should be ended with He Is Deceased and have the Israelis get up and walk out of the room.

But Palestinian prisoners get visits from their lawyers, some get conjugal visits from their wives, they study for university degrees (at the expense of the Israeli government), etc. Gilad Shalit only got a one way video and 1 letter out, no visit by the Red Cross as required by international law, no visit from his lawyer (he was not convicted of anything), etc. Palestinian prisoners are convicted criminals Gilad Shalit is a kidnap victim. So no, there is no comparison to Israel living up to international law and Hamas failing to.

Palestinian children, 14 years of age are tried as adults in Israeli Military court and are often put with Adults in prison. These are direct violations of international law. Hundreds of Palestinian prisoners in Israel are in prison without charges or a trial. Israeli prison without fair trial or conviction, psychologically destroys these children.
