Gilad has had no trail, indeed there will be no trial because he was kidnapped whilst doing his duty protecting his country. As he was inside Israel at the time he was kidnapped, no court of law would be able to prosecute him anyway. Hamas prevent him from receiving any statutory rights either as any prisoner is entitled to or as a prisoner of war, such as the right to contact his loved ones or the right to visits by the international red cross. Such rights ARE permitted to those Hamas and other Palestine affiliated prisoner in Israeli custody no matter what their crimes. Who knows what physical or mental torture Gilad has gone through these last 4 years with no state ombudsman or state legislation to protect him as an unarmed prisoner who is open to the unhampered mistreatment of his disgruntled captors?

Holding someone without pressing charges and without giving the defendant the right to know or respond to charges is just plain wrong. It doesn't matter if that is applied to a Palestinian or to an Israeli citizen. There are people who are sent from their homes in some sort of internal exile and that is done on the basis of information from the Shabak that may have not real basis. The best protection for human rights is to avoid administrative measures and to rely on a truly independent judiciary (not judges working hand in glove with the prosecutors office).
