1. Why?
John ,   Herzliya, Israel   (06.25.10)
Why is IAF using expensive bombs? Prepare something like Qassams and start firing it to Gaza, wherever it strikes, it strikes.
2. the moment you say warehouse, those are legal weapons
observer   (06.25.10)
they are not hiding those in underground or in mosque.
3. To: No. 2
Sarah B ,   U.S.A. / Israel   (06.25.10)
Yes. And they fired them at Israel. And Israel replied, with fully legal deadly force. Thank you for acknowledging the use of lethal weapons against Israel -- which, needless to say -- entitles Israel (a sovereign nation) to respond appropriately. Which they did. See how easy that was?
4. omg observer
maradonna   (06.25.10)
just stop fighting everything... it is what it is, you don't get an inch of what's going on here. you're a media pet and an arm chair critic, nothing else... get a job dude, seriously.
5. Israeli Response
Yaakov ,   New York   (06.25.10)
The Israeli Government is pathetic, Before I clicked on the article I already knew what their respnse was. Bombing tunnels and warehouses. Perhaps if they hit a few people the Arabs would think twice about firing the next time.
6. anything in a warehouse is legal??
Dina   (06.25.10)
That's a first! 1. Stolen goods in a warehouse are legal.... 2. None legal drugs in a warehouse are legal. And of course because they are in a warehouse they are legal and can be sold in the open market and used by all. 3. Home made and smuggled weapons in a warehouse are legal and can therefore be used against anyone and anywhere. Good God observer - get a life!
7. I DO NOT GET THE POINT...
JOE ,   KFAR SABA   (06.25.10)
I DO ONT GET THIS STUPIDITY THE IDF KNOWS WHERE IS A WEAPONS WAREHOUSE LOCATED AND BOMB IT AFTER KASSAMS ARE FIRED AT ISRAEL . I THEY KNOW BEFORE HAND WHERE TO HIT WHY THEY WAIT TO ACT TILL WE ARE ATTACKED ? THEY SHOULD BLAST THEM ALL AT ONCE AND THE GAME WILL BE OVER END
8. Nation?
Resistor ,   Sarah #3   (06.25.10)
Israel is a state, not a nation. Define Israel's borders if you can.
9. braverman and leiberman
alexi   (06.25.10)
labour and kadima are wimps of the first oder. Lieberman advances and exchange of peoples where they reside in a reasonable manner. After all, the treasonous majeled says israel is not his country nor lieberman his foreign minister. So fine, let them go by law to their country palesitne. Israel doesn't want them except for those who swear allegiance to the state. Otherwise kick them out. Barverman and livni, 2 olmert wimps shout this makes israel appear bad to the world when the world could care less about israel. livni minded an apartment for the mossad while braverman did nothing substantial for the idf/ These are 2 losers like olmert the biggest coward in israel's history along with ehud barak who even the military finds pathetic these days. I applaud lieberman's proposal/
10. #2 - it's a war Hamas declared...all weapons are targets
William ,   Israel   (06.25.10)
which is perfectly legal...unlike your friends in Gaza who target only civilians.
11. #8- "Nation" refers to collective psyche of population
William ,   Israel   (06.25.10)
"State" refers to logistics and borders, dumbass. Your's is a stupid argument. There are more than a handful of countries all over the world who have border disputes with their neighbors, most notably is Iran with the occupation of UAE islands and Turkey with the occupation of Cyprus. Then there's China and India, India and Pakistan, Morocco and Western Sahara, etc. Give it up - your Leftist tirades are boring and ill-thought out.
12. smuggled or not; legal weapons according to jus cojens
observer   (06.25.10)
Latin meaning: "compelling law." This "higher law" must be followed by all countries. For example, genocide or slave trade may be considered to go against jus cogens, due to peremptory norms. So, what's genocide if it is not stanglulating siege in the air, water and ground acess of Gaza; starving and bombing 1.5 million residents? The 1986 Vienna Convention on the Law of Treaties affirmed jus cogens as an accepted doctrine in international law. Smuggled weapons and tunnels in Gaza are legal under the jus cogens. What is the flagrant illegal here is the siege.

Sarah B ,   U.S.A. / Israel   (06.25.10)
OMG, you are DUMB! Why don't you google "nation-state?" That's actually the formal term.
15. To: No. 12
Sarah B ,   U.S.A. / Israel   (06.25.10)
Sigh. Non-lawyers should not practice law. I'll try to break this to you gently .... Israel is not signatory to the 1986 Vienna Convention on the Law of Treaties between States and International Organizations or Between International Organizations (VCLTIO). None of its terms, conditions and provisions apply to Israel, as any Convention applies exclusively to ratifying countries. Besides which, both the earlier Treaty (1969), which was called simply "Vienna Convention on the Law of Treaties" applies exclusively to treaties between or among sovereign nation-states. Gaza is non-sovereign territory and has no standing to assert a doctrine of jus cogens (which doesn't apply in the sense you are trying to extrapolate, anyway). What you have failed to mention (not surprisingly) is that jus cogens does not apply to Gaza (it is not a sovereign state) or Hamas (terrorist organizations are necessarily extrajudicial entities and as such cannot claim protection under international law). I shall repeat the key statement: Israel is not a signatory to the 1986 Convention. I believe only around 31 countries actually are.
16. IDF strikes in Gaza in response
Robert Cabitt ,   Boston, MA, USA   (06.26.10)
The rockets will continue to rain on Israel until they elect a prime minister who has the will and the courage to drive the Palestinians and Hamas out of Gaza and the West Bank. When George Bush gives back his Crawford,Texas ranch to the Native Americans is when peace will come to Israel. To the victor goes the spoils. Americans killed thousands of Indians during the conquest of the United States. The Indians that survived were placed in concentration camps euphemistically described as reservations where alcoholism and unemployment reigns. Since the Bureau of Indians Affairs has granted gambling casino licenses, some Indian tribes have prospered. Maybe gambling casinos are the solution for the Palestinians.
17. #12 - I love this real stretch to reach your point, Observer
William ,   Israel   (06.26.10)
"what's genocide if it is not stanglulating siege in the air, water and ground acess of Gaza" Well, in the dictionary, it's defined as the mass killing of an group based on ethnicity. This "strangulation" you speak of has to fulfill at least that one part, doesn't it? The siege has been in place for 3 years....where's the massive dead, Observer? Is it one of those slow, drawn-out genocides that take 10,000 years?? Even Ma'an news disputes your claim that Gazans are starving...and judging from Ali Waked's article about the expensive villas on the beaches, you can hardly count them in the 1.5 million "starving Gazans". I am only dismayed at one thing about you Observer. That you didn't extrapolate further and claim there are really 2.3 million people in Gaza - 97% of them children under the age of 5, and 20,000 civilians died in Cast Lead, all holding white flags and beg cups. My advice - hold still for a while so Hamas PR can catch up with your mindless antics.
18. Consider this ....
theprophet ,   USA   (06.26.10)
Do you realize you are seeing Bible prophecy being fulfilled? Notice how Israel is almost to the point of totally standing alone? You may ask, how about the United States? Don't bet your paycheck on it! Care for a preview? Read Psalm 83.. Talks about a group of nations coming together to remove Israel from being a nation. Then, read Isaiah 17:1. It talks about Damascus becoming a ruinous heap. Then, check out Ezekiel 38-39 and notice which nations are involved. You will also find out what the outcome will be. And remember, the Bible was written almost 2000 years ago.... Now that is accuracy! Now, for you folks who don't agree with the above, everyone has free will to either agree or not. However, one day you will have to decide if you are with GOD or against HIM.
19. #15,17 breaching peremptory norms
observer   (06.26.10)
compelling or higher law which supersede any other law or treaty. it applies whenever there is breaching the peremptory norms. The number of peremptory norms is considered limited but not exclusively cataloged. They are not listed or defined by any authoritative body, but arise out of case law and changing social and political attitudes. Generally included are prohibitions on waging aggressive war, crimes against humanity, war crimes, maritime piracy, genocide, apartheid, slavery, and torture. Even; "A treaty is void if, at the time of its conclusion, it conflicts with a peremptory norm of general international law. For the purposes of the present Convention, a peremptory norm of general international law is a norm accepted and recognized by the international community of states as a whole as a norm from which no derogation is permitted and which can be modified only by a subsequent norm of general international law having the same character." Israel should be the first country to enforce the jus cogens because the Nuremberg Trials was the first enforcement in world history of uncontroversial international norms upon individuals.
