I'd say that's a pretty accurate description. Personally, I think the entire Court should be replaced. Nomination to the Court should require confirmation by the Knesset. Also, the Court should have no jurisdiction over security issues.

Aharon Barak is the worst thing ever happened to Israel law system. His approach made the law system a massive money grabbing system, in Israel the percentage of lawyers is huge, unbelievably huge, because of money. If you have a problem, Aharon Barak system means you need money to get justice. Pay and they'll enforce the law. The criminals never had better life in a democracy, they have more money than the average Israeli Joe, and they can do anything they want and win in courts because they have money. There is no justice, its a system without moral, and Barak himself sported 12 houses for himself. Don't follow him and his system, there are so many drawbacks that it is too small place to even get started.

Anyone who supports Aharon Barak is not suitable to be an American judge. American Judges must be subservient to the law as passed by the people's representatives and must respect the Constitution of the United States including the separation of powers. Barak has proven time again that he believes that the law, the executive and the legislature are subservient to the all-powerful "Philosopher Kings" of the High Court who can decide a case as they wish.

Kagan is well-qualified for the position. I trust Justice Scalia, a sitting member of the court, far more than I trust former Judge Bork, a dork who was rejected for the Supreme Court because of his bizarre views.

Judges like Barak who believe everything is subject to their own judgment and values are making legislators and the executives who represent them irrelevant. That's what makes them dangerous. The US Constitution address the issue of all-powerful judges through checks and balances. Here the executive branch nominates, but the legislative must confirm our judges. It's long past time for Israel to do likewise.
