This is the most rediculous thing I have ever seen. You cannot blame a soldier for doing soemthing like this. It is exactly what soldiers are taught to do and I can guarantee that I would have done the same. In a hostile environment when you are warned of an attack under civilian guise, which is not at all uncommon, what is a soldier expected to do? This situation is rediculous, soldiers cannot be tried on the same gorunds as anyone else.

You are operating in a theatre of war. Your enemy dress as civilians. Your enemy operate from within civilian areas and among civilians. They are known to use suicide belts, men and women alike. They approach you flying white flags. Do you trust them and allow them to come near or do you prevent them from doing so? Let's use a little common sense here. Don't blame the soldier; rather blame Hamas for perfidy. Would you serve as a soldier if the rules of engagement prevent you from placing your and your comrades' lives first?

Let's just keep some perspective here. Palestinian policy, both Fatah and Hamas, is to shoot to kill Israeli civilians. There is overwhelming factual evidence that proves this, as well as on-the-record reports by all major human rights organizations. It's time to get the Palestinian leaders arrested and put on trial - especially since it is clear that they are refusing to negotiate peace despite repeated calls by the world to do so. This following statement relates to both Hamas and Fatah. It is not recent, but comes from 2002 - proving that Cast Lead was indeed justified, and that Palestinians are indeed war criminals: "The attacks against civilians by Palestinian armed groups are widespread, systematic and in pursuit of an explicit policy to attack civilians. They therefore constitute crimes against humanity under international law. Even Judge Goldstone himself can't believe that the Palestinian leaders haven't been touched: "... the [Goldstone] report contains the clearest finding that Hamas and other militant Palestinian groups committed serious war crimes and possibly crimes against humanity. 5. Put the prosecutor on trial!

Any judge that accepts this case, and allows a "trial" of this soldier to be held in his court, needs to be locked up!
6. Did anyone examine the feet of the person shot?

It could be the soldier shot and hit the feet and as the person was falling was hit on the ground with a bullet to the upper body. The shots of warning were probably also misunderstood as shots that missed and not as shots to stop advancing. Just so that no possible mistakes like this happen in the future, there should be a loud speaker telling them not to advance and if they do, then they would be shot. There would be open fire orders to kill after this announcement.
