Legally the status of the West Bank falls under the international law of belligerent occupation, as distinguished from nonbelligerent occupation that follows an armistice. This assumes the possibility of renewed fighting, and affords the occupier "broad leeway". The West Bank has a unique status in two respects; first, there is no precedent for a belligerent occupation lasting for more than a brief period, and second, that the West Bank was not part of a sovereign country before occupation—thus, in legal terms, there is no "reversioner" for the West Bank. This means that sovereignty of the West Bank is currently suspended, and, according to some, Israel, as the only successor state to the Palestine Mandate, has a status that "goes beyond that of military occupier alone." Regardless of the choice of punishment, the child is entitled to an education. What a backward nation! Eli if you think it so wrong that he hurled stones at soldiers, tell us what you think of all the settler children who hurl stones at women and children with impunity under the watchful eye of members of the IDF. Israel wants their Arab neighbours to recognize Israel as a Jewish State and yet it is incapable of abiding by the covenant to have just laws. What kind of twisted people are these?

Facts are more important than opinions! Military occupation occurs when a belligerent state invades the territory of another state with the intention of holding the territory at least temporarily. While hostilities continue, the occupying state is prohibited by International Law from annexing the territory or creating another state out of it, but the occupying state may establish some form of military administration over the territory and the population. Under the Martial Law imposed by this regime, residents are required to obey the occupying authorities and may be punished for not doing so. Civilians may also be compelled to perform a variety of nonmilitary tasks for the occupying authorities, such as the repair of roads and buildings, provided such work does not contribute directly to the enemy war effort. Although the power of the occupying army is broad, the military authorities are obligated under international law to maintain public order, respect private property, and honor individual liberties. Civilians may not be deported to the occupant's territory to perform forced labor nor impressed into military service on behalf of the occupying army. Although measures may be imposed to protect and maintain the occupying forces, existing laws and administrative rules are not to be changed. Regulations of the Hague Conventions of 1907 and, more importantly, the 1949 geneva convention for the Protection of Civilian Persons in Time of War have attempted to codify and expand the protection afforded the local population during periods of military occupation.

According to all international laws the land west of the Jordan belongs to us period. The Arabs have not a single legal claim to any of the land. Finding any Israeli kids throwing stones at Israeli soldiers is hard because that is not our national sport. Second any Israeli throwing stones at soldiers don't get house arrest - they get prison time until trial. So yes there is a double standard - Jews get harsher treatment than Arabs.

Obviously patient reading and politeness are sadly not your forte. What I posted is International Law and you obviously didn't take the trouble to read and digest what I wrote. I am write wing, and find the law very encouraging. What is most interesting is that although the West Bank is technically occupied because it was taken during a war, it is unique because it didn't belong to a soverign country before that, so there is technically nobody to return it to. I provided you with the law as it stands but there is much more to discover if a person is interested in learning. The greatest barrier to learning is thinking that one already knows. Michael

Because we were given the land according to several treaties, including the UN Charter it was not taken by us. When you regain your own territory during a war - this is called liberated, not taken. It being our territory in the first place, the Geneva Convention does not apply at all. That is the real issue I have with what you posted.
