Because if the land on which the home was built by Jews is either Jewish land or State land purchased by Jews, and permits were valid, then there is nothing else to talk about. Now, the "refugees" who lived in an Jewish home illegally since it was stolen from the Jewish owner during an ethnic cleansing must either pay rent to the actual owners OR leave. Ethnic cleansing is a war crime, committed by Arabs in 1948, and has no statute of limitations. The act of stealing the property and giving it to Arabs by the Jordanians is both admitted to by the Jordanian govt and the Arab families who took possession. The fact that they lived in it since the 1940s means nothing. Many Jews who lived in that same neighborhood, and Hebron, Beit El, Jericho, Gush Katif (before 1948), etc, have been there much longer than 60 years but Meretz NEVER shed a tear nor cared about the moral or legal implications of their forced expulsion in 1948, nor even the rights for Jews to keep control of such holy buildings as Tomb of the Patriarchs. This is just an attempt to gain the favor of Arabs and demonize settlers.

Spread city services to all parts of Jerusalem and make it under Israeli control! By keeping services and infrastructure to a minimum in E. Jerusalem neighborhoods you keep the fallacy that Jerusalem is indeed two part of the same city, and E. Jerusalem is Arab when infact it was stolen in 1948. Screw the politics and the Leftist haters - take the city back to 1947, unify it, and make it the official Jewish capital finally!!

It's not a reciprocal matter. There's no equivalence here and what's being suggested gioves disproportionality a bad name. This seems more about winning and slow pushing non-Jews out than about following the law. Israel is currently strong and many Jews want to see the dream of a Jewish only Holy Land realized, with Temple Mount under only Jewish control. In 20 or 30yrs the Muslims may unite and then return the favor as history has showed in the past. What do you want for your children and grandchildren, more wars or a life of peace?

Jerusalem was 1/3 the size, if not smaller in 1947! To claim Palestinians have no right to live where they have for generations is patently denial of reality. Humanity shares the fate of the planet, - Israelis must come to terms with sharing the land.

As Chris Christie once said, "if you want to legislate, get off the bench and try getting elected!" The court has no right in this situation Bet Yonatan is a Jewish building. As for the Arab majority in so called east Jerusalem, land ownership is not sovereignty. They can own all the land they want. according in international law, treaties, and cease-fires the land from the sea to the border of Iraq is Jewish. Jordan has no legitimacy.

Thanks for this. It is indeed absolutely ridiculous to equate the illegal colony of Beit Yonatan in Silwan (Occupied Territory) with the status of the former Yemenite synagogue, which has been the home of 1948 Palestinian refugees for the last 50 years or so. Indeed, if this will go ahead, then all the homes stolen from Palestinians in 1948 in West-Jerusalem should be sealed, and their rightful Palestinian owners be allowed to return to them.
