The law can be envoked ONLY if the victim is a US citizen.The article mentions that. Did you read the article? If a Palestinian who is killed was a US citizen, his estate can file suit. Somehow, I think there would be more lawsuits against Hamas or the PA, since more Palestinians have died at the hands of other Palestinians than have died at the hand of anyone else since Hamas took over the Gaza Strip. BTW, how many Palestinians do you think hold US citizenship? And if they do, how are they still considered "refugees", who are, by definition, stateless?
