While a divorce is tragic, there are accentuating situations where its necessary.Jewish law does not condemn a woman to live a lifetime of misery. Everyone deserves to be happily married. Although the Rabbinical court can put him away for up to ten years, he can get out in an instance if he agrees to divorce his suffering wife. The rabbis are not idiots, rather the man is. He has such hatred towards his wife that he would rather suffer for ten years or more than let her free to live a free life. It is a ruling that does to him as he is doing to her.

He should be declared mentally incapable of making any decisions and the Court should be able to award her a "get". Why should she be punished for the rest of her life!

Two posters have mentioned a supposed American law that a couple defaults into divorce if they are separated a year. No such law exists, and in America divorce can be every bit as awful. However, one important difference is that in America woman are not treated as second class citizens by the curt systems. This BS would never fly in the US, and no America woman would tolerate it.

This should be done to anyone who refuses to give his wife a get. If it doesn't work, cancel child visits, put them in solitary, worsen their food, etc, until they give in. It's easier to hold out with a release date.

How in the world is this remotely fair? The man doesn't give his wife a divorce but he gets 10 years harsh confinement? How long does the average person convicted of robbery serve in Israel? How long does somebody serve for assault? This is a travesty and no justice at all. He served his time. They could not break him so they force him back to prison maybe for life. By any standard this is cruel and unnecessary. Can Israel lock up anyone who disobeys religious law indefinitely? Why not execute him? That would be more humane.
