...there are many women, who have their children suffering, because they mustnt see their fathers... ...fathers kidnap children - its usually a punishment, not necessarily in favor for the children (culture, blah blah).... ...or others (mostly men) who kill their children, the wife/or themselves, as sort of punishment...

When rabbis will admit that the halacha is wrong and has to be changed, then we'll get out of this mess. There should be rabbinical courts that declare such husbands as unfit to be a spouse, and thus the beit din will grant the get for him. Until something like that happens, all the rabbis will sit around, wring their hands and go 'oy oy oy' and do nothing else. If a cherem (boycott) and shaming doesn't work, the rabbis have to conclude that the man is evil enough to warrant the beit din assuming the responsibility. In the meantime, women and children suffer, and the rabbis still sit around going 'oy oy oy'.

Why the only democratic country in middle east should serve such a down-graded imperfect law? So what if it is written in jewish law? As there came a law of man marrying only one women and many more, why our rabbies are not daring to do and imply and modify the current injust law? Why to chain a women on man's wish and grant? Has anyone noticed that such a unjust law is giving way for criminal acts? Kidnapping and black-mailing and trying to kill him? I hope our rabbies will do what is needful.

- the Waxes are heroes. Of course, they're Modern Orthodox - no Haredi would ever show that much concern for an agunah, unless a large sum of money were involved. Unfortunately, the Haredim now control all of the beis din, as well as the rest of the Orthodox communal infrastructure, so no changes will be forthcoming. Their world is collapsing, but not quickly enough to prevent them from draining Israel dry financially. It will be bankrupt within a generation; tragically, as they go down, they'll be taking Israel with them. It appears as though they'll get their wish - Israel will be gone, but it will cost them their entire subculture to accomplish it.

But the get isn't valid until both husband and wife consent. If one party refuses, the other cannot remarry or procreate without the children being considered illegitimate and prevented from ever marrying religious Jews. - this statement is misleading in that the wife only has to receive notification of the divorce, she does not have to agree. The power to give or withold the get is with the man. There are no "chained" men.

I gave the ex a get years and years ago. She still keeps on bugging me. She calls all the time. I keep telling her she got the wrong number. I repeat myself all the time.. "I am not the ROYAL BANK OF CANADA....Have a nice day!" I better call DR Phil.

US and the apply to well meaning Orthodox as well as rapists who cross state lines. The rabbi and his helpers could be doing some serious jail time unless they get a sympathetic jury. It's nice to help an aguna, but maybe having a bunch of masked men would have been a smarter tactic than a known rabbi. The legal bills will be huge and no rabbi should be in prison over this.

if the new york courts won't interfere in the "religious matter" of a get, perhaps a jury will also rule that kidnapping, in such a case, is also a "religious matter" and outside the court's jurisdiction.

I know it's not funny, but holding a guy's head under water trying to "finalize" a divorce is hilarious. But why the Hudson river? Wouldn't a toilet bowl do? Actually, a .38 is an even better "persuader," and won't waste or pollute water. A .22 might do, but it makes just about as much noise as the .38 and I don't think they make hollow-points for 22's :-)

are looking at LONG jail time in a FEDERAL prison. These guys can't say "I was a well meaning bumbling fool that was just trying to scare him." You think they are not going to make an example of him so NO OTHER RABBI does this in America? You can bet they are going to hand pick a nasty prosecutor, this guy is in trouble. If you are going to do something like this, NO ONE should know who the heck you are, certainly not invite the guy to your home and tie him up. OY VEY, what not to do.

Israeli and other Rabbinates must have an internet website where they can publish names and photos of these men who refuse their wives a get. When they abscond to places such as Thailand, South America or Australia the whole Jewish community will know not to offer them work or acommodation, and hopefully will convince them to do the right thing.

Michael Boryde is a hypocrite. When the woman finally gets a GET at his beit din after many years, he refuses to release the GET receipt so she can remarry until there is a civil divorce. (Meanwhile, her biological time clock keeps ticking.) On the other hand, if a man remarries without a civil divorce (thus bigamy which is a crime) and the wife is left without any $ support (you cant sue for support while still married) , Broyde says he doesn't want any American law telling him he cant marry a man who is a bigamist. Double standard??? I think so.

The cherem, or excommunication, is a very powerful tool, and here is how it was designed to work: No one can talk to him No one can stand within 4 cubits (approximately 2 meters) of him He can not receive any honors in the synagogue, nor can he be counted toward a minyan No one can do business with him. This includes buying/selling anything, even basic food staples! If everyone would adhere to these rulings a recalcitrant husband would very quickly come around. Unfortunately, we don't live in a perfect worl, and one courts rulings are not upheld by the other courts, leading to unfortunate situations. Not mentioned in the article are the times that the woman refuses to accept a get unless her demands are met. In most circumstances, a woman's refusal to accept a get makes it invalid. I personally know of situations where this has happened.
