Israel says its Gaza blockade is a precaution against arms reaching Hamas and other Palestinian guerrillas by sea. Comment - Israel is facing missiles fired from Gaza almost on a dayly basis, this is actions of war but, are not acting according to Justice of law, when preventing those Missiles to reach Gaza. Israel can only hold those firing those Missiles personaly responsible, the population of Gaza has no responsibility whatsoever. This Usefull Idiocy can only rise the feeling of rage in me because this is sheer hostility, nobody sober of mind can come to such conclusions as those UN experts. Israel's naval blockade of the Gaza Strip violates international law But when Hamas or any other terrorist group shoots rockets or mortars from Gaza into Israel, which were hidden in ships supposedly carrying "humanitarian aid" (remember the Iranian boat that was searched and was found full of rockets, missiles and other weapons), than there is no violation of international law? Reports aren't written condemning Hamas? This panel of "human rights experts" can take their report and shove it as far as possible!

of course falk and the others like goldstone, chinkin and desmond collected and collect huge fees for ignoring hamas rocket fire and breach of israeli sovereignty and condemn the collective punishment visited on gazans by israeli measures and hamas itself. Remember goldstone himself said he was afraid for his own safety when he went into gaza. Now falk attacks palmer whose report was balanced while pillay and goldstone reports were biased garbage reports that had no connection with reality. laws of warfare have to be renewed because hamas and hezbollah launch deadly attacks from mostly civilian quarters and of course ehud barak is afraid of them. As the egyptian assault on the israeli embassy proved once again, all of gazans are guilty that they lend huge support to terror and if need be they need to be hit. The un should be named the united nations of arab because everyone else is excluded unless they buy their cheap lies.
10. UNHRC and Falk ignore one important thing

Namely, the human rights of Israelis which are being violated by Gazans through an illegal war and constant terrorism. The UNHRC purposely ignores this part of the equation because it helps to bloster the argument that this is solely a "human rights violation of Gaza" position, and not an existing war. By trying to cover-up the illegal war Gazans declared on Israel, they're attempting to erase the conclusion of legality by the Palmer Report. Still, Palmer wins here because conventions of war usually trump specific human rights conventions due to the complication involved. There is no precedent nor resolutions that call for adherence to human rights of one population at the expense of another population. Ergo, the only way out is for Hamas to end its war and smuggling weapons, which in turn would end the justification for Israel's blockade. Adding another complication to the mix - Arafat signed over land, sea, and air border control to Israel in the Oslo Accords, until a sovereign State is created.

Their big claim to fame was a women's rights activist from Malaysia. and yet they call the Palmer Report, led by a seasoned expert on maritime law, flawed and politicized.

There are plenty of laws on this situation which are credible and have been used to address the blockade in the past. Ergo, there is no justification to supercede it especially since all groups admit there is no humanitarian crisis in Gaza, and Israel exceeds the minimum requirement of a power enforcing the blockade to take care of citizens' needs. Nice try though.

Two can play at that game. I can say there is jus cogens law against randomly firing off Qassams and Grads from Gaza and that the groups doing so have subjected Gaza to jus cogens law. You are writing from Egypt. Egypt has a border with Gaza and if it believes this is jus cogens law, it can provide Gazans with all he electricity and materials they want. Of course, if they do, and Qassams and Grads keep flying, Egypt becomes subject to the current jus cogens law against supporing terrorism, as well as materially breaching Camp David by its support of terrorism. Anyway, I think that the "new Egypt" is the one encountered by that 60 Minutes journalist who was sexually assaulted. I have yet to hear Egyptians say that mob was not representaive of them. Egypt should apologize for that before requesting anybody else apologize to anyone.

The people of Gaza have collectively elected Hamas a known terror organization. They bear full responsibitities for any collective punishment that comes from such a terrorist government's actions. What is the difference between Nazi Germany's citizens who elected Hitler and supported him. Did they deserve to see their homes and country ruined by the allies? Same is true in Gaza. Let them elect a peaceful government and then we shall see a different reaction from the Israeli side.

A true form of "collective punishment" besides the fact that it already is a "war crime". is the intentional targeting of civilians. By all accepted norms, the rockets from Gaza that intentionally target civilians is a "war crime". Add to that, 24 people have been killed, hundreds wounded, and entire towns, men, women, children, senior citizens have been forced to live in bomb shelters. Forced to live in fear of their lives. Now wouldn't that be considered "collective punishment"? If not, why not? All attacks on the Jewish civilians are unprovoked, and the terrorists who fire the rockets face no immediate danger...or any kind of danger...to their lives. So self defense cannot be even considered as an excuse.
