A bill from the right, another one from the left, and so on and so forth, dealing endlessly with things that should have been fixed once and for all. A constitution achieves it and Israel needs a constitution. Instead, politicians like Mofaz find a way through such bills to waste their own time and time of everybody else. Politicians like the waste of time so much that they always find better things to do than drafting a constitution.

Where you stand depends on where you sit. The left is delighted to have a liberal/left judiciary, answerable only to itself and praises its "independence". The right is frustrated that the judiciary is self-selecting and unaccountable to the public. The US system is of course quite different because it's not only founded on a written constitution but that Constitution posits both separation of powers and "checks and balances". The Executive branch nominates candidates, but they must be vetted and affirmed by the Legislative branch, who are themselves held accountable to the public. One needn't belong to the left or right to see the US system works better than that in Israel. Israel's left has no case.

All the liberals who support freedom of expression ought to worry when foreign money is trying to influence and direct the rights that Israelis die to give their nation. The liberal push back on the NGO bill is unwarranted and stupid. Every democracy has laws to protect it from outsiders buying influence including the US where foreign agents are required to register under the Foreign Agent Registration Act. Duh, what’s the big deal if Israel follows suit. We all know that anti-Israeli NGOs are seeking to influence Israeli policies and that cannot be tolerated. Israel even has foreign governments donating money to influence Israel policy and that must end. This bill is one way to accomplish that. Get Soros and the haters out of Israeli politics.

EVERYTHING that Livni and Mofaz accuse Netanyahu of is actually true of THEIR OWN LEADER, Ariel Sharon! While Sharon was dodging police investigations into his corruption (for which his son was finally convicted), PM Sharon actually DID everything that they accuse Netanyahu of. One week later when he saw he could not win the Likud primaries he left for Kadima. remember how in June 2005 Mofaz PROMISED how he would not support any Gaza withdrawal that abandoned the Philadelphi strip of land - well, a few weeks later he did exactly that.

I've been a professor of law for more than 32 years and I can tell you that these allegations are nonsense. You folks in Israel need these laws specifically to PROTECT your democracy, not damage it. The Israeli supreme court has an amount of power unheard of in other democracies and often to the detriment of the state and its citizens.

We all know war is hell. And in that hell you're supposed to kill only bad guys and do your best not to kill innocent bystanders whom the law says are neither bad nor good - they're just innocent. So after the war in Gaza (Cast Lead), along came the NGOs all heavily funded by the European Union, and they beat their breasts and declared that Israeli soldiers may have committed war crimes and must therefore be investigated and stand trial for war crimes. The there are the Palestinians, who the international human rights organization Amnesty International concluded not only committed war crimes, but had a policy of doing so. These same Palestinians continue to this day to commit war crimes. And the European funded NGOs who claim to be "human rights" organizations? Did they beat their breasts and demand war crimes trials for Palestinians? Of course not. Because the radical Left (they only part remaining, since the moderates long ago gave up) has killed democracy and given us instead Animal Farm: All people are equal before international law, but Palestinians are more equal than others.

..State of Israel is essentially a battle of truth, where we have a patriotic Jewish majority in Israel fighting an Arab fifth column in cahoots with extreme left wing Jews/Israelis supported by anti-Semitic Moslem countries and Europe. The battle for truth is not over until its over. Everything Livni and Mofaz are accusing Netanyahu of is something they themselves have done. For example: Avi Dichter accused Livni of turning Kadima into her own party. Livni is not exactly a democratic person. Kadima under Olmert and Livni failed in Lebanon. Gilad Schalit was kidnapped while Livni and Olmert were in power. Sharon's Kadima are responsible for the ethnic cleansing of Jews in Gaza. Ariel "Arik" Sharon was involved in corruption scandals in the past, and again - I want to repeat that he ethnically cleansed my countrymen from Gaza and Sharon, representing Likud and then later - Kadima, wanted to infringe and limit the rights of the Israeli central bank and preventing it from delivering or executing objective and professional economic policies. That's completely unheard of in democracies that a government should tell the central bank how they should conduct the financial policies of the state. Limiting the power and tenure of judges in Israel's Supreme Court is not undemocratic - it is very democratic, since a shorter tenure would suggest that judges themelves do not stand above the law and they too need to gain the respect and trust that political parties and Knesset from time to time need to prove they have. Livni and Mofaz are first class liars and hypocrites. When "settlers" are manhandled by Israeli soldiers - they are quiet. When Arabs (Arab terrorists) are manhandled by Israeli soldiers - Livni and Barak protest. When 'right wing" organizations are denied financing there is no uproar or complaints about lack of democracy. There is only an uproar and compaints about lack of democracy when "left wing" organizations and traitors - officially organizations of "peace" and 'human rights" but in reality supporters of Arab terrorism against Israel and enemies of Israel and Israel's Jewisness - that's when Livni, Barak and Mofaz voice concerns about lack of democracy.

It is democratic because it shows that judges of the Supreme Court don't stand above the law - they too must be held responsible before the law and before the electorate. Limiting their tenure is democratic because it limits the political power of the judges. It means that ideologically motivated judges - no matter if they are "left" or "right" cannot enforce their will on society and use their previously long tenure as an excuse to exert power that is simply way out of proportion in relation to their official duties. And limiting the funding of left wing extremist organizations is very democratic since it hinders and blocks them from causing harm to Israeli society. Preventing extremist organizations from causing the society harm - isn't that democratic - to safeguard freedom which is fragile and precious?

Without commenting about ideological differences, I think, as a friend, that Israel needs a written Constitution, on American model; with separated and balanced Powers. As a Judge in my country, I endorse independent Magistrates, not attached to political parties, but only upholding Law, as a whole. Salutes.
