1. The Supreme court is NO democratic
(12.01.11)
2. don' t be afraid of Beinish: BAN the Supreme Court
(12.01.11)
3. Mrs. Beinish
Abraham Nachmias ,   Petach Tikva IL   (12.02.11)
Ignores the basic rule of democracy: "vox populi, vox Dei" She believes that "enlightened" people like herself, know better than us lesser people what is good for us! That's a sort of theocracy that she wants!
4. #2
Spencer ,   Israel   (12.02.11)
What a stupid, idiotic, puerile statement. It must be a reflecyion of the kind of person you are.
5. # 3 I have in my life
Sagi   (12.02.11)
never seen so much nonsense crammed into three lines.
6. Are you sure #4? I happen to agree with #2
Israeli 2   (12.02.11)
7. Hello, Kettle? This is the pot calling.
5th generation ,   Israel   (12.02.11)
DB, as long as you run a system giving the police more support to harrass honest citizens than prosecute criminals, you are an enemy of the state.
8. to #3
Stan ,   Israel   (12.02.11)
"vox populi"?? Hitler was elected democratically. Most Germans favoured slaughter of the Jews. If the majority wants something does that make it right? I have witnessed the working of the Supreme Court in Israel for the passed 50 years and can assure you that there is no other body more sane or just.
9. Human Rights Democracy
zichron   (12.02.11)
The Shoah has taught us we need thehuman rights in the de mocracy and we need to be warriors skilled ruthless and cunning .The suicide bombers got in through weak security both defense and offense has to be strong . But the human rights is essential so people question and evolvestalinsrussia survived because the people knew they knew they had america andthe u and its dominions as allies. Theeffect on morale must have been vital and the usa was in part at least a human rights democracy.
10. The sooner Dorit retires, the better
Reuven   (12.02.11)
She has done much harm to our security. She has no right to interfere in miltary matters.
11. Is it sane enough?
Gilon   (12.02.11)
Like many elite institutions, Mizrahi Jews have been under-represented till this day by elite minority. This needs to change.
12. Supreme Court's job is to apply laws. Not make them.
Chaim ,   Israel   (12.02.11)
It is Beinish who is lacking in understanding. Not, for the most part, Supreme Court critics. The role of court judges is to apply the law. Not to make it. Making law is the role of elected Members of the Knesset. Yet time after time, the Supreme Court has effectively made laws to suit it's heavily left wing biases. Israel is fed up with it.
13. Leftwing run institutions delegitimized themselves!
who cares   (12.02.11)
They're pretending unfairness to protect themselves....Fact is : in Israel as well as in other western countries the left has taken over the media plus the judicical system long ago - now they're whining when this is disclosed...... Of course they fear for their influence and their great salaries - they dont care for the society.
14. Supreme court's DICTATORSHIP !
Mark ,   T.a. Israel   (12.02.11)
This Court thinks they are untouchables pretending they rule in the name of DEMOCRACY ? Democracy means THE PEOPLE RULES ! If the PEOPLE IN MAJORITY is not content of them they should resign ! VOX POPULI is the best choice in some cases ! In USA we see THE GRAND JURY of PEOPLE in in special cases ! The Members of SUPRIME COURT should be APPOINTED BY AN IMPARTIAL JURISTS and MINISTER OF JUSTICE and not by the SAME UNTOUCHABLES ! AND DO NOT FORGET : RAISON D'ETAT ( THE SURVIVAL OF THE STATE ) IS # ABOVE # ALL CONSIDERATIONS !
15. # 8 Stan "Vox populi"
Sagi   (12.02.11)
It is a very common fallacy that Hitler was elected by popular ballot. Read history and make yourself knowlegable. Julius Caesar was not a Roman Emperor but most people, when asked, will say that he was.
16. Israel Needs a Constitution ASAP
Noah Lev ,   LosAngelesUSA   (12.02.11)
As an American, I am disgusted with the "protesters" here, and their cost to our cities and states (who pays for the mess left and overtime for the police?), But, the law prevailed Free speech as we all know, is not absolute. Dont yell fire in a movie theatre comes to mind. Freedom to protest, and organize has limits. Many in the movement want democracy to die out..replaced by G-d inows what. Some in the 1% BTW are we Jews, who were educated, worked hard, and built foundations (yes, and fortunes). But most are NOT Jewish (Gates, Buffet, etc.). I watched, as the LAPD, after several warnings, broke up the thousands who had massed at the City Hall environment, blocked the streets, and urinated at will, defending themselves with vinegar and anti-acid, plus masks. Israel is a nation of protests, protests galore, all over the place, Anarchy is just below the surface. Yet the judicial is tolerant of these mal ajusted Jews, and Israeli Arabs ( Nakba Day and the Wall, come to mind), also illegal settlements. 7m people, with 7m voices. Wont work. 2 yr retirement parameter is nonsensical. Knesset laws which violate Israel's basic laws, are illegal. Israel is both insane and insane. Perhaps a Constitution is what is needed, to codify for all to see, using the British Laws, basic laws, and the US as an example. The sooner the better. Israel seems in a fog at times, not knowing where its headed.
17. What a farce
David ,   On this planet   (12.02.11)
She said democracy is also maintaining the essence of democracy, the basic values of respect, human rights and in Israel, simultaneously with all these, the values of a Jewish State. Beinish and the members of this Supreme court have nothing in common with being Jewish except their wish to be called the Jewish state. JEWS DO NOT THROW OTHER JEWS WITH THEIR CHILDREN OUT ON THE STREET AND DESTROY THEIR HOME .You have to earn it to be Jewish , so far you did not earn it. You are a secular Israeli with some Jewish roots at best
18. DEMOCRASY IS NOT 'MAJORITY DECIDE' [GREEK]
BUTSeriously ,   Sydney   (12.02.11)
True Democrasy is 'DO NOT FOLLOW A CORRUPT MAJORITY' [Hebrew bible]. Arafat, Sadaam Hussein & Hitler were democratically elected Greek style - not Hebrew style.
19. The Supreme Court has too much power
Vlad   (12.02.11)
The High Court of Justice is one of the most activist courts in the world. The radical left uses the High Court as a tool to achieve its aims. The court itself is dominated by leftists who have enabled Arab traitors to serve in the Knesset in defiance of a law stipulating they have to recognize a Jewish state. It has also placed constraints on IDF operations and security measures that enjoy broad public support, and limit settlement construction often on flimsy evidence, including decades-old photos showing Arabs farming the land, at the behest of B'Tselem, Peace Now and Adalah. The High Court has also overturned laws to liberalize the media and privatize sectors of the economy. The High Court must be reformed. Period.
20. Good riddance to leftist Jew haters.
Bunnie Meyer ,   Los Angeles, CA USA   (12.02.11)
21. #8
MARk weisshaus ,   new york, us   (12.02.11)
obviously thinking is one activity you do not indulge in. Hitler was elected but then he went and broke Germany's own laws. get it? Look at democracies all over the world-one way or another the people via their elected officials choose their supreme judges. We in Israel do not have the people involved in selecting the judges who will decide major decision of the day. It is the people right to decide who will judge them. Judges can not select other judges. Listen what this tyrant in black robes says-the judges will protect the democratic values of the state. Wrong-the people via the knesset have to choose what the values of the state should be. This Beinish is confused and has a distorted view of democracy-judges interpert the law as made by the knesset. judges are unelected -the more they decide what is the "correct" value of the state the democracy there is in israel. Bottom line-this fraud-Beinish is a politician-disguised as a judge. She is a tyrant.
22. Democracy
Joe Sombrero ,   USA   (12.02.11)
It shows how bad the justice system is when Beinisch calls free speech incitement. While the supreme court justice system in the United States is not perfect justices are at least picked and confirmed and approved by representatives of the government elected by the people. It is called checks and balances it is called democracy. The whole idea of the process is to have a team of judges making the decision based on existing law not ideology and based on proof. It's a step-by-step process with the cases either approved or denied with a appeal process by the merits of the case and existing evidence before it reaches the Supreme Court of the United States. Tell me how is this incitement.
23. beinish
colin   (12.02.11)
Let her fall. This leftest jude did everyhing against a free Israel. She ordered men and woman removed from thier homes at night by the cowardly roveling bara's nazi troops She does not believe that yehuda and shomron are Israel, She is against any freedom of movement by soldiers in gaza. Get rid of this useless woman.
24. To # 8 Stan
Abraham Nachmias ,   Petach Tikva IL   (12.02.11)
Dear Stan, democracy is one person, one vote. Simple. We need rules of course and a constitution that limits what is permitted and what is forbidden What we don't need are self elected people who decree what is good and what is right. The Weimar Republic felled because of being too addict to law, so Stan, try not to defend an illustrated tyrant.
25. Our Supreme Court is an abomination without equal in the
tom ,   tel aviv   (12.02.11)
Western Democracies. What are you all babbling about?! Sure, Mrs.Benish has to lash out- it's her duty to preserve her "way of life" just as any person holding a job or position in any society. Still it is a dubious Club on that mole-hill in Jerusalem....
26. The Problem with the High Court....
Reuven Brauner ,   Raanana, Israel   (12.02.11)
is, in no small part, due to the incorrect understanding of its members regarding its function in society. Former Chief Justice A. Barak and his female successor are activists with an agenda and, it is probable, are many of the other justices. They all have attitudes and world-views. That's where the problem begins. Rather than adjucating cases in accordance with an objective understanding of the law, they superimpose their political/ideological bends to their decision-making. As a result, their rulings become skewed and out of touch with the general public. Not good, Doris.
27. RE: stan, Israel
Correcting mistakes   (12.02.11)
Democratically? Questionable, but maybe so. However with the relative minority of the voting public (electorate) at then elections, that's for sure and it's actually true!!!
28. to #8. So - no more elections ?
2Mad ,   צרפת   (12.02.11)
And about 50 years of witnessing - it's heavily dependant of which side of stick one holds.
29. This is So Pathetic
David Samuel   (12.02.11)
Does anyone not see the irony of this particular act in the play? In Israel we have the fascist left and the fascist right. We are free to choose which we prefer.
30. Thanks for the proof
Igor ,   Germany   (12.02.11)
If I had any doubts whether the power of the Supreme Court needs to be limited, Beinish dispelled them with her statements. She is clearly overstepping her authority and violating the separation of powers---a fundamental pillar of democracy. As a judge, she is obliged to follow the law, not to make it!
