While I am completely for Israeli Settlements, everywhere in Ha Eretz, In this case, where the settlers built on private land belonging to so-called palestinians, I need to acknowledge that the court did right in rejecting the settlement. Had the settlement been on public land, it would have worked.

The court is suposed to judge between litagents based on the law, not tell the law makers, the police, the radio, the newpapers what they can and can not do. The Judges have overstepped their roles of decided legal issues and have gone head long into politics. this is very bad for the state and for justice.

Occupation can ONLY take place when State A conquers State B's territory as a result of war. There was no "Palestinian" state in 1967, 1949, 1948, 1947, 100 , 200, 500, 1000, 5000, 10.000 or 100.000 years ago. No "Palestinian" state has ever existed in recorded history. Therefore there is no "occupation". Many ancient civilizations among them the Jews/Israelites themselves, but also Phoenicians, Philisteenes, Canaanites, Edomites, Egyptians, Hittites, Babylonians, Assyrians, Persians, Greeks, Romans, the Byzantine Empire and the Arabs ALL mention the Jewish people and Israel - both as an independent/sovereign Israelite/Jewish kingdom and also Israel in the sense of the land of Israel. None of these civilizations have ever mentioned any "Palestinian" people or state - not once. Why? Is it extremist to point out that our Jewish homeland is de facto our land? Zionism has existed for 2000 years of Jewish exile, but Zionism as a political movement came into being in the late 19th century. The purpose of Zionism was the reestablishment of a Jewish state in the ancestral Jewish homeland. There was no mentioning of "West Bank", "Palestinians" or "occupation". Zionism intended to resettle the land of Israel - and to be more exact the land area designated by the San Remo treaty in 1920 which includes Cis-Jordan (including Jerusalem, Judea, Samaria, Gaza and Golan), Trans-Jordan and southern Lebanon up until the bend of the Litani River. The political hysteria concerning "Palestinians" and "occupation" started in 1967. We Jews have HISTORICAL (not only religious bonds) and LEGAL rights to Israel. What EXACT connection do Arabs have to Israel? What we patriots of Israel don't understand is why Tel Aviv or Jerusalem is more Israeli than Judea and Samaria. If you think we are "stealing" "Palestinian" land, then why not extend your ideology to all of Israel? The 1949 armistice line is an armistice line remind you - no permanent border.

FYI, the so-called West Bank has a name :Judea and Samaria or Yehuda and Shomron...And by its ancient name alone, that area has its only natural and hisotrical owner for thousands of years: Israel . There are no more "petitioners". Peace Now withdrew their petition on behalf of the Arabs on Nov. 7, 2011 because that was the deadline for them to provide proof of ownership & they had none. The Migron residents were never given a chance to prove their ownership. The case should've been closed when the petition was withdrawn. This is purely a political decision by the left-wing court. Judicial activism has no place in a democracy. The court does not have the right to determine policy.
