Who are the legitimate owners? It has been proven in court that no one owned the land. No one even claimed the land until the foreign-funded "Shalom Achsav" group paid someone to falsely claim it. If someone has any deed, it can only be from when Hussein distributed the land at his whim. Considering that the Jordanian occupation was illegal, such a deed is no better than a forgery.

It has been proven in court that the land is privately owned by Palestinians, whether they were present or even alive is irrelevant. This is not settlers' land, period.

Nothing but blatant racism is behind tearing down Jewish communities in Judea and Samaria. All of Patriotic Israel must demand unrestricted Jewish building throughout Judea and Samaria. This land has been ours for more than 3,500 years. Those who tear down Jewish communities and/or faciltiate such destruction must be put on trial.

There is a deed in existence. It is called Tanach! A Covenant is a Contract. The Land is contracted to the sons of Ya'acov "FOREVER!" BTW, Avraham paid a very high price for Hebron which was given illegally to the pali interlopers. The government of Israel is breaking covenant and must be replaced.

The case in point regarding Migron claims "private" ownership not by a person but by a neighboring village. There were no municipal borders created or a plan presented to any govt, whether Ottoman, British, or Israel (let alone Jordanian) to this effect by the village yet today they claim the land is required for planned expansion. That type of claim is not protected as "private land" under previous laws nor conventions. Now, if the land is indeed under private ownership, proof must be established - which means actual land deeds or atleast registration in Ottoman era records.

Lots of claims have been made by Arabs but a well-rehearsed story and rusty key doesn't prove ownership. They have been asked to prove actual ownership to which Leftist respond with claims of "indigenous people", "Zionist/settler conspiracies", "ICJ ruling (though just advisory and non-binding". At the end of the day, I cannot pitch a tent in a public park and claim it as my private land, and neither can Arabs, whether done in 1964 or 1934.

Although someone registered the land in the Jordanian tabu, he died 50 years ago without heirs. Since he did not purchase the land, but received it as a gift from the Jordanian government, BY LAW the land reverts to the sovereign -- Israel. The High Court did not examine the documents and relied on what the Civil Administration falsely asserted. The lower court, which has the authority to examine such documents rejected the current Arab claimants.

in the South of the country. How? There's no diffinitive proof of ownership by the tribes so the argument by the lawyers went: "it's just the right thing to do because other countries are creating a trend of acknowledging 'indigenous people' rights to the land". Now, if they can only claim these tribes are indigenous. How? They claim anyone who came before 1948 (Jews don't count here no matter how long they've lived in the region) is now "indigenous".

(ynet decided not to allow my link to psak din for some reason, let's try again) Both bagatz and the state itself agree that migron was built on private land, this is illegal, what more do you need ? the phrase "private palestinian land" is all over the psika, go to bagatz website and see for yourself. Even if the person to whom the land belongs died 50 years ago in no way it would be given to any Israeli, he would have given it to the first Palestinian he met if he really didn't have a heir. Exploiting some bureaucratic loophole is below any settler.

govt, regardless of his heirs or claim to the land, it is NULL and VOID according to the Geneva Convention which outlaws illegal annexation and land theft through ethnic cleansing. If this person received the land from the Jordanian govt, it is akin to receiving stolen property which could translate into his guilt if he knowingly took stolen property. Nevermind a bureaucratic loophole, the real issue here is a legal one and an infraction of the Geneva Convention that translates into a war crime. There is no precedent, legal or moral, that allows for such a crime to be sanctified over time. and we haven't even gotten into the discussion of whether the person who took ownership of the land resided in the area prior to 1948 or was a recent immigrant after 1949 which is also a war crime under the same Convention barring the forced immigration of foreigners into a region won by war.

You're shooting yourself in the foot by bringing up Geneva convention as according to it the whole Jewish settlement enterprise of west bank is illegal. Bagatz acts upon Israeli law alone, if it found that the land is owned by some Palestinian it is so according to Israeli law, not Jordanian. And it is not only Bagatz that considers this land Palestinian , which as a result predictably gets called a radical leftist court and so on, but the state of Israel itself. We don't know anything about the person who owned this land originally so there's no point speculating about Jordanian past and so on.

Segal wrongly assumes that because Palestinian claims haven't been accepted that they won't be "building a home or planting an orchard there anytime soon". Does he not realize how much illegal Arab construction takes place both within and beyond the Green Line? Does he not know how much Jewish and state land has simply been grabbed? Yet neither the IDF nor the police do much about it because "it's a sensitive issue".
