As long as Hamas isn't part of the Palestinian Authority, they have no standing with the ICC. Last year the ICC prosecutor rejected a PA attempt to sue Israel specifically because "Palestine" did not have nation status. Neither does Hamas. The only way for Hamas to gain that status now is either to go to the UN and demand nation recognition for the Gaza Strip as a separate entity (unlikely) or to form some kind of unity government with Fatah (even more unlikely). However, it did give me a good laugh for the morning...

Every day I read the paper and the message from Hamas is always the same. It always consists of threats and acts of intimidation against Israel and members of the IDF. The present threat is a continuation of the evil conduct of Hamas. I say enough is enough. It's time to make their lives miserable. Cut off the electricity, expell all foreign Arab workers (even tho them come from Judea and Samaria, their relatives in Hamas will get the message) cut off the food from Israel (let them get it from their Arab brethren). Give them some real pain. Israel owes them nothing!

... is cut off Gaza's electricity and fresh water. Stop the weekly convoys of humanitarian aid to Gaza. Tighten the border crossing again. Let their brand-new best friend (in domestic upheaval and dead broke Egypt) do the heavy lifting. It will be nothing if not amusing to see how that plays out. Hamas is in desperate need of a reality check. This absolutely outrageous threat is just the ticket, and a perfect excuse for the State of Israel to teach that terrorist rabble a very valuable lesson.

The cynical use of our egalitarian laws to justify terrorism is the ultimate insult, making our legal system a complete farce. It cuts both ways however. Economic realities such a the insurance industry must begin paying attention because such abuse causes many levels of economic breakdown., and if leaders of nations refuse to call terrorism for what it is, perhaps finding that chaos in whole economic sectors of trade may bring these leader to their senses.

The more I read the more I think that the Palestinians have a fundamental misunderstanding of what the ICC is and how it operates. It is not like a domestic criminal justice system where you can just report anyone for any "crime" you think and have them investigated and charged. In order for the ICC to have any jurisdiction there has to be a referral of a whole situation in a State (either by the UN Security Council or by a State Party to the ICC) and the ICC will then investigate ALL crimes by ALL sides in that State. If Hamas try to complain about the Gaza blockade to the ICC they will very soon find themselves up on war crimes charges (indiscriminate rocket fire at Israeli civilians, using civilians as human shields, etc.) for which they are guilty as sin and have literally no defence. On the other hand, the complex legal debates over Israel's actions - including very difficult questions about proportionality, knowledge, military objectives etc. - could be almost unresolvable. Also, if "Palestine" accepts jurisdiction and this extends to Gaza, they will be under an obligation to arrest and transfer to the ICC anyone who is in "Palestine" and is indicted by the ICC. On the other hand, Israel is not a State Party to the ICC and will be under no obligation to hand over any Israeli - who will be safe as long as they stay in Israel. The Palestinians may in the last week have started to use the "ICC threat" for everything they don't like that Israel does, but in reality, going to the ICC is going to present serious problems for them.

Mashaal is coming to Gaza. During Pillar of Defence he expressed his desire to die as a martyr. Maybe as attraction to Hamas' 25th anniversary rally and the Pillar of Defence exhibition they'll shoot him, while sitting on one of the M-75 Hamas missiles or on one of the Fajr-5 missiles, far into Israel. It makes me remember Kubrick's film: Dr. Strangelove. He will be a martyr and will be rewarded with 72 virgins or like another explanation says: with 72 grapes. Oi, I hope for him - or not - that the grapes (the second interpretation) will not have a sour taste.

A few months ago he said Gazans were really Egyptians and Saudis. Historical fact agrees with him. Most who fled during the war, without ever seeing a soldier, didn't own their property in Israel. They were renters or squatters from the 1930s. But don't forget, 1/6th of Gaza was Jewish land and given up in 2005 in an attempt for peace,. Gush Katif has historically been Jewish, as Haniyeh admitted to. We can also call back that "loan" so don't get nasty.

None of the UN "experts" headed by Falk have experience in the rules of war or maritime legal issues. That's why they're not experts on this case, and that is why the UN as a whole adopted the Palmer Report, headed by a seasoned Maritime Law expert, which justified the blockade and called it legal. How can you claim there were no legal experts? Palmer himself is a LAWYER! Which do you think the ICC will select? well, they're driven by actual intl law and seasoned experts on such issues, not opinions from an ignorant twit with his own agenda. Keep in mind - once the Pandora's box of ICC is opened by the Pallys, they can receive as well as give - and there are plenty of people waiting in that line to make the Pallys pay for their decades of war crimes, including Western nations whose citizens were purposely targeted.

I've been thinking this since the day they used threats of the ICC. Either the "Palestinians" will break the system because of their attempt to politicize it, or they will become the targets of war crimes indictments embarrassing those nations who voted in favor of a Pally State at the UNGA. My guess is - the ICC will be stripped of its power and legitimacy, and become yet another lawfare tool that amounts to nothing. You know what they say about "good intentions"....
