Jailing divorce refusers???!!!
2. men are denied divorces too
poiuy ,   israel   (04.14.13)
men too are denied divorces. after a man gives the get the woman must accept it. she can hold out for more money. there are an almost equal number of man agunim as there are female agunot.
3. Simple solution:don't get married in front of a snake-oil
tom ,   tel aviv   (04.14.13)
peddler. Your kids will be Jewish anyway and the foggy-minded Men In Black will have to find alternative & PRODUCTIVE way of making a living. Especially in light of statistics: every third marriage will end in divorce!
4. 3tom And those children might...

become 2nd grade citizen in this cruel cruel world....

as the halacha demands, it works.
6. A sick society
Miriam ,   Fairfield, USA   (04.15.13)
Judaism began as a religion of growth and more civilized behavior than those around it. It has stalled in the backwaters of time and become a sick relic of abuse and domination. That a society in the 21st century would allow individuals to be chained in this way, either women OR men, is disgusting and barbaric. No wonder civilized Jews from the US are beginning to withhold their support. We've advanced; there is no reason to support a country of such backwardness.
7. A divorce refuser has the nature of a dove which is a
Rivkah   (04.15.13)
symbol of the Ruach HaKodesh or Holy Spirit. A dove mates once for life. If the mate dies, the widowed dove does not take another mate for its lifetime. Truly, that is the higher road that the Rabbinical Courts hope for. Rabbi Yehoshua of Nazareth said to separate not to divorce unless there is fornication in the marriage (adultery). Shaul of Tarsus added abandonment as grounds for divorce if the one leaving is an unbeliever that means the believing spouse is no longer under bondage and is free to remarry. But the problem with divorce is explained by Rabbi Yehoshua who said, "If anyone divorces his wife and marries another, he commits adultery. And anyone who marries a woman who is divorced causes her to commit adultery." Unrepentant adulterers and unrepentant adulteresses do not enter God's eternal Kingdom. Therefore the get refusers if they are innocent of Scriptural grounds for the divorce should be hailed as heroes and heroines of the faith.
8. Why quote Saul of Tarsus?
Miriam ,   Fairfield, USA   (04.15.13)
Saul of Tarsus, otherwise known as Paul, the organizer of the early Christian church, is absolutely irrelevant in Jewish law, as is Jesus, so why is he being referenced? None of us Jews care at all what Jesus or Paul said, because *it's not relevant to Jewish law, which is what is being discussed.*
9. Complicated case
Joseph ,   London UK   (04.15.13)
It's not clear when they married and when she converted to Judaism. Can the Beth Din not retroactively disqualify the conversion and thereby invalidate the marriage, and then let her re-convert? Reb Moshe Feinstein ztl permitted the invalidation of Reform marriages to avoid second marriages without a Get from leading to mamzerus. There was meant to be a world conference of Dayanim to discuss the Agunah issue, but it was postponed, apparently because no one had any realistic proposal on how to resolve the matter. Pre-nupts seem to be the best bet in Israel. Here in the UK we have the Jakobovits rule that says a civil divorce cannot be completed unless both parties are 100% free to remarry .

hey thats their right to believe so , but it dont mean diddley when talking about israel.
11. Giving a Get
Sherlock Holmes ,   London England   (04.15.13)
Jewish Law permits a marriage or a divorce only if both parties agree. It has always been assumed that if the Beth Din ruled that a husband must give his wife a Get, he would automatically do so because every person wants to do what is right. It's only in recent generations that men have abused this system with relative impunity. Maimonides ruled that a husband who refuses must be flogged until he agrees, but that method is obviously no longer in use. We need to have pre-nuptial agreements, just as the Rabbis instituted the Ketuba or marriage contract setting out the husbands duties and protecting the wife's rights.
12. Two ways to release an agunah
Danny ,   London England   (04.15.13)
The late Dayan Berkovits of London told me he once trailed a husband to Israel and demanded that he grant the wife in London a Get to be deliverd by the Dayan. The man flatly refused to grant a Get, and the Dayan told him, 'There are two ways to free your wife, and giving a Get is one of them.' Within a month the husband died of a heart attack, freeing the wife. If only Divine Providence were always so visible!
13. Other religions' approach
Joseph ,   London UK   (04.15.13)
In the Roman Catholic Church divorce is not allowed. In the CVhurch of England [aka Anglican or Episcopalian] divorce is permitted but no remarriage while first partner is alive. Judaism allows a divorce for any reason if both partners agree. I have the feeling that Islam may allow divorce even if the wife does not agree. Every system has its limitations. Civil divorce involving children has a wide range of problems. Some countries say the children should go with the father, others say the mother, others say ask the children, causing them untold pain having to choose between parents.
14. only way to solve that: civil marriage!
Ze'ev   (04.15.13)
Otherwise there will always be Get refusers, paining women.
15. more men being refused gets than refusing to give
Nofyah ,   Jerusalem   (04.15.13)
WRONG, there are actually more women who are get refusers than men. One of them advertised this on her Facebook wall which is how I got the link. But in her case, she is insisting on a prenup she doesn't deserve because she wasn't civilly divorced from her previous husband and is forbidden to the man she had hupah and kiddushin with. The Rabbinute actually described her as a zona in the psak din.
