This decision is bound to be appealed and to get certiorari. There is a problem with the executive branch stating that the law is an impermissible encroachment on the executive branch: President GW Bush signed it. He cannot undo in a signing statement that which he actually did in signing the law. If GW Bush had vetoed and Congress overrode, it would be a slam dunk that the law is unconstitutional. But this Supreme Court is likely to stick the branches of government with the consequences of their own actions. That is what first-year law students learn is called "estoppel". Now everyone can feel free to argue about Balfour and the UN General Assembly and Zionism and indigenous rights and everything else that has nothing to do with the legal case.

The sad truth is, no American born in Jerusalem has a country listed in his US passport. It simply states 'Jerusalem'. The crazy part is if the same US person fails to fill in his/her place of birth as simply 'Jerusalem' without stating the country of birth on any other city,state or federal files form it will be rejected as incomplete.

...League of Nations, legally, that designated 23% of then Palestine as the "national home of the Jewish people", located between the Jordan River and the Med. Sea, including Jerusalem of course. This legal act was then adopted by the UN and etched into its Charter, article 80, 1945. Incidentally, the Arabs, the League of Nations recognized and the UN accepted, had been handed over 77% of then Palestine, located between the Jordan River and the Arabian desert. Sadly, the US President, instead of showing the lead in living by international law, continues to spit at it...!!

This case had absolutely nothing to do with foreign policy or the US/Israel relationship-- it was entirely about the separation of powers within the US government and whether passport authority (regardless of how it's used) should belong to the administration or Congress. Stop being so damn sensitive-- the fact that the specific example that was being sued over happened to involve the status of Jerusalem was nothing more than an irrelevant detail to this case.

That they don't accept East-Jerusalem, shameful but gotten used to it. But now they're basically saying whole of Jerusalem isn't Israel? So where the hell does the Knesset meet, the Prime Minister live and is Yad VaShem located? All places Obama and other foreign dignitaries visit while in ISRAEL. Somehow I thought only the post-67 borders were controversial, but turns out if you were born in a street that has been Israeli since 1949 this is still disputed by the US.

Pleasee. East Jerusalem was captured by the Jordanians in 1948 and liberated by Israel in 1967. The Palestinians have no claim, other than one invented by Yasser Arafat when he concocted the myth of a Palestinian people. If the Palis want a capital, should they even get a state, they have Ramallah.

As long as Haredim continue controlling the city and disturbing it while police is not enforcing the laws of the country, Jerusalem is outside of Israel to me. As long as the fanatical cult Haredim don't obey the laws of Israel in Jerusalem, close off streets and terrorize women while police does nothing, Jerusalem does not belong to Israel. Israel needs to prove to the world that it wants Jerusalem to be its city, its capital city. This is not the case now.

The Jewish people had survived Egyptian slavery, Babylonian slavery and destruction of 1-st Temple, Roman burning of the 2-nd Temple, destruction of Mossada and supression of Bar Kochba revolt and forced dispersion after that, Spanish and Portuguese Inquisition, British persecution and banishment from Britain, Polish, German, Russian Empire pogroms, Holocaust. The modern State of Israel had survived 5 wars and was the victor in all of them and numerous military conflicts as well as acts of terrorism by their neighbours. So what to write in the US Passport beside Jerusalem, it's nothing. It won't change the ownership of the city. By the way, in spite of all the above calamities, Israel is a very proserous country. I invite you to visit as I am Israeli citizen too. It's much more prosperous than your own country. Trust me.
