1. High Court has no business making laws..

The High Court is has only one function. To interpret existing laws. It has no business making laws. The time is long overdue to make the High Court properly subservient to the Knesset and the will of the people. Israel needs new legislation to put the High Court in its place. There is also a need to change the composition of the High Court and replace destructive leftists with patriots.

When you have tens of thousands of people here illegally some you accept are legitimate refugees and a solution needs to be found to reflect that and some are just illegal economic migrants then you have to investigate individual cases and to do that you need to hold them all under one roof. It takes years to deal with tens of thousands and until somebody has had their case investigated then you cannot charge them with a crime or not. Its only practical they can be detained for up to 3 years to give time for them to be dealt with but the idiot judges decided to be humanitarians.. Its not inhumane or a breach of human rights to lock up somebody who enters the country illegally and the idiot leftist judges don't seem to be able to get that into their thick skulls. The judges and leftist politicians like Shelly Yachomovich and other far left members of Labor and Meretz praise the decision of the judges but at the same time say how much they feel for the residents of South Tel Aviv and accept something needs to be done. How about we move them all to Ramat Aviv and Herzliyah Pituach when they become a problem for the very rich then lets see how long the court think that infiltrator rights come first. Take to the streets nationwide, people sat up and noticed when the social protestors came out in the hundreds of thousands don't just leave it to the residents of South Tel Aviv to protest and not be heard. Find out who the judges who made this ruling were and name and shame them and same with any politician who supports this decision. You want to get something done properly then the only way is to do it yourself

There is a legal pretext to incarcerate these people should they try cross into Israel- illegal immigration! Why is this not enough for Israel? It is a law in every other nation and no one else deems it unconstitutional. Isn't it simple: break the law = jail?

As usual Chaim "shoots first and asks questions later" The Supreme court has not "made " a new law. It has simply told the Knesset that the law in question will harm Israel. In addition the Supreme court demands that the Knesset pass an Immigration Law which will deal with these problems.

There are an awful lot of people looking to escape their hellhole homelands. Should they all be welcomed in as a "humanitarian right"?! Courts should NOT legislate. Ever. That is simply NOT their purview and usurpation of the Knesset's legilative brief is inexcusable. Economic sanctions against offeending court figures is not out of line. Continued abuse in this manner screams for removalfrom the bench.

Mr. Okon may or may not be a mensch, but he is definitely naïve. Even history's greatest empire, Rome, fell to barbarian invaders over time, so why couldn't little Israel become overwhelmed by unchecked waves of illegal migrants, especially when those invaders are mainly from Muslim countries hostile to Israel. The Torah does not require Jews to act against the interests, even the continued existence, of the Jewish state. And surely even Basic Law allows people to protect their homeland!

To a galutnik who has read an Israeli (English-language) newspaper for 39 years (and visited Israel six times), the lack of an immigration law is unsurprising. I love Israel and the idea of Jewish sovereignty in our homeland, but beyond defending themselves, Israelis as a community or society seem almost incapable of getting anything done. The urgent (usually) gets accomplished. The rest? Manyana, if ever. Probelms are studied by experts, solutions are recommended, and the efforts moulder on shelves and the problems continue for years, even decades. Regrettably, the United States seems to be headed in the same direction, thanks to politicians who will not cooperate. In fact, the legislative problem here is worse than Israel's. I don't think Israel should be expected to take in just anyone who crosses into its territory; no nation does.

Around 60,000+ people have already entered the country they continue to enter illegally and they are not all here for the same reason, some are refugees, some are economic migrants etc. Some we will let stay, some we will deport to a third country, some we will just kick out but unless we know who is who and what's their story we can't do anything. When you have tens of thousands here you cannot process them all within a week, it takes years. You also cannot charge somebody with something until you know who they are. These people obviously want to stay in Israel so they will not come forward to be processed knowing they may be deported so only solution is lock them up in a detention centre until their case can be investigated and their future in Israel decided. It's purely a practical bill not one designed to punish.

The ruling notes the Torah directive to respect "the stranger" - individual. But that same tradition says nothing about accommodating tribes of foreigners who decide to make your home their own. Many laws are written with an individual in mind, and presume procedures and mechanisms that can deal with said individual. But what of untold thousands of such individuals? Can any system provide the legal representation, the judicial review and the legal remedies each "deserves" and not be overwhelmed? That's a bigger issue that neither the "rights" community nor the Court has addressed.

Legislators tried to pass a law where any person suspected of being an illegal can be arrested for 3 years without trial. You can arrest illegal immigrants but not without due process and a trial. So the High Court is protecting those who are not illegal immigrants, even plain Israelis, from being locked up for 3 years on suspicion of... . And the moral of the story is if you're going to write a law, do it properly!
