I see no legal issue either. The whole problem is that the bodies are given a hero's return. Candies are being thrown and they celebrate the way they died - murdering Israels of all ages. It encourages terrorism, celebrates martyrdom, and is an injustice to the Israeli victims and their families.

Israel is giving the families of murderers the ability to make heroes out of them. Abbas will speak glowingly of them and name streets and parks after them. Israel should cremate the bodies and dump the ashes into the sea, where they can sink to the bottom of the ocean and remain in the cold and wet ooze for eternity, forgotten by everyone as if they had never existed. The terrorists' families petitioned the High Court? The judge should have told them they have no legal standing and to stop wasting his time.

12. Government Policy Makes No Sense

The government's policy of seeking acceptance from the Arabs makes no sense. Since before independence the Jews have sought to be accepted by the surrounding Arab populations. They have bent over backwards and made useless concessions all in the name of peace. Handing over the remains of ruthless terrorists is just one more example of the idiocy that pervades the government. It gains Israel nothing and merely allows the terrorists families the ability to create a shrine to their dead. The time has come to move beyond this galute mentality. The situation needs to be reversed. It should be the Arabs who are asking the Jews to be accepted. They are a primitive and for the most part an uneducated society. Israel does not need them, they need what Israel has to offer. Preserving these remains does not further the interest of peace. It simply creates symbols of so called martyrs who will serve as examples for future terrorists. The political echelon of the government does not know how to stand up tall. The IDF wins all the wars and the political echelon gives away the peace. Its time for a reversal of direction.

These bodies should be returned only after there is a comprehensive peace treaty, or we get something of value. A gesture, means we turn them over for nothing. This is poor bargaining. The HCJ should be told that they are being held pending a peace treaty.
