Hate to rain on your parade, sluggo, but the ICC was created by treaty; a treaty which the State of Israel has not ratified. Neither, for that matter, has the United States. The ICC therefore has no jurisdiction over the State of Israel. And it probably would not be terribly wise for an organization -- pick any "Palestinian" organization you want; they have all engaged in brutal terrorist activity and in war crimes against the Jewish State and the Jewish people -- to want to challenge the State of Israel in a forum which deals exclusively with war crimes and crimes against humanity. In fact, it is the last thing on earth they would want -- they have far too much blood on their hands.

ICC can prosecute any person who has committed a serious war crime or crime against humanity and is arrested in any state that has ratified ICC treaty. Decades lasting collective punishment of millions of civilians, acts of apartheid in Judea and Samaria and brutal arrests of children by occupying state are serious war crimes. But you don't need to worry, border policemen and IDF-soldiers are safe. ICC can only prosecute main suspects who are making the decisions and are therefore above the national law. ICC has only jurisdiction over genocide, crimes against humanity and war crimes, so the sporadic terror acts by Palestinians and Israelis can and should be prosecuted in Israeli courts. If Palestinians (or Israelis) commit a serious war crime like using weapons of mass destruction, it would off course fall into ICC jurisdiction.
