The ICC also needs to remember that the sovereign State of Israel has an affirmative duty to protect and defend its citizens and its borders. Terrorist groups such as Hamas and Fatah, on the other hand, enjoy no such right.

The ICC also opened a preliminary probe into the Gaza flotilla because the ship was under the flag of a member state that requested it. They found it had insufficient evidence to prosecute. The same thing will probably happen here. They'll probably conclude that Israel's court system is able and willing to investigate, but if not, all Israel has to do is refuse entry to them and not hand over anything they ask for.

The State of Israel did not -- and will not -- ratify the Rome Treaty which established the ICC. The ICC therefore has no jurisdiction over Israel and over Israeli nationals.

ICC investigations will target both Israeli and Hamas officials, thus Abbas will kill two birds with one stone.

This is a joke to start with, of course, the notion that the Palestinians can influence any rule of law against Israel under the ICC, even as a "member." I doubt that they can. Abbas is automatically implicated by virtue of the unity agreement with Hamas. He cannot step back from it, and his verbal exortations to the "palestinians" are a matter of public record.
