1. ICC has no jurisdiction over Israeli nationals

israel is not a signatory of the rome treaty and therefore the icc does not have jurisdiction over her nationals. the territory that abbas claims is not a state and therefore not a sovereign that can legitimately adhere to the rome treaty. the secretary general of the united nations cannot decide unilaterally that there exists a palestinian state that can sign on to international treaties. furthermore, the icc cannot under any circumstances decide whether a given territory is occupied. such a decision is purely political and is outside the jurisdiction of the court.

Abbas going to the ICC is a direct violation of the Oslo Accords IDF will be investigated for defending Jewish children from rocket attacks launched from territory given by the Israeli Left, using weapons purchased with international humanitarian aid The US guarantor of the Oslo Accords supports Abbas. Neither Herzog nor Livni are even thinking of defending IDF against these accusations
