it is clear to impartial observers that the high court needs to be reformed. in particular, the selection of the justices must be more democratic. the justices cannot be allowed to self select. the knesset should be given a larger role in the approval process of justices. furthermore, the jurisdiction of the court needs to be defined clearly and it must be curtailed. the high court should not have jurisdiction over political matters which rightfully belong to the executive and the legislative branches of government. those branches are democratically elected by the people. the high court must serve the people, not special or foreign interests.

barak clearly spits on the main principle of a democratic rule of law, which is montesque's trias politica in which the judicary only checks the laws created by the legilsator and upheld by the third power. As a leftist he made himself judge andlegislator, which totally undermines the rule of law in favor of the rule of the leftwing ego! Do us all a favor mr. barak. Do not use terms you clearly do not understand!

Two other examples of democracies that have been curtailed by leaders voted in are Turkey and Venuzuela. Those countries' respective judicial systems did not stop Erdogan and Chavez from adding to their power and harrasing democratic oppositions. Having said that and agreeing with Barak, I think that Barak would have to agree that in Israel the balance is tilted in the other direction thanks to Barak's judicial activism.
