The fact that the British failed to fulfill their obligations and disregarded all responsibilities of the mandate doesn't mean that they had any legal right to do so -- it only shows that they had the military might behind them vis-a-vis the defenseless Jews, who had no power . The facts that Faisal declared the treaty moot only proves the point that one shouldn’t put too much trust in treaties in general and especially NEVER rely on any treaties and agreements with the Arabs. And that’s why Jews should NEVER trust anyone where their safety, wellbeing and protection of their rights are concerned. The betrayal first by Europe and now by the U.S. and Canada and the rise of the new anti-Semitism only prove that point and that is why Israel should not relinquish an inch of the land to the Arab terrorists squatting on their land.

I will address the points made in post #7 in order of their occurrence: I presume that Dr. Yoram Shifftan did not mention the Fourth Geneva Convention, because although the Israeli Supreme Court ruled that it in effect applied, in truth it has no direct application to Judea and Samaria under international law. Since the Fourth Geneva Convention does not apply under international law, please be more specific regarding the refugee issue in international law. Resolution 242 spoke of a "refugee problem" without qualification, so even you would agree it would apply equally to Jewish refugees who fled Arab countries. You seem to think the Arab "inhabitants" had implicit sovereignty. This is a common Arab myth and since other experts have already disposed of it, I do not want to belabor the point. Putting the Feisal-Weizmann agreement aside, Feisal was the authorized representative of the Arab national movement including the Arabs of Palestine at the Paris Peace Conference. In two official memoranda submitted to the Peace Conference, he excluded Palestine from the territories demanded by the Arab national movement. [The full citation is Nathan Feinberg, The Arab-Israel Conflict in International Law (A Critical Analysis of the Colloquium of Arab Jurists in Algiers) (1970), reprinted in Studies in International Law 454-55 (1979).] I assume the Mandate for Palestine superseded the Sykes-Picot Agreement of 1916. There is no doubt whatsoever that the Mandate was a valid act of international law. This is not the time to go into the legality of the Churchill White Paper to which you refer. Rather I would point out that the Churchill White Paper said that the San Remo Resolution "is not susceptible of change," and the San Remo Resolution de-facto granted national rights exclusively to the Jewish people. The third paragraph of your post is vague, so I have to give three interpretations: 1. There is no doubt whatsoever that the British actions to restrict Jewish entry into Palestine under the British White Paper of 1939 violated the terms of the Mandate, if this is what you are referring to. 2. Or are you referring to the fact that the British aided the Arabs in the 1948 war against the Jewish state, which prevented Jews from settling Judea and Samaria during the period when Jordan illegally occupied it? It goes without saying that these actions were illegal. 3. Or are you referring to the memorandum approved by the League Council on July 24, 1922 that in effect created a Transjordanian province of the Palestine Mandate? This is not the time to go into its legality. The legal status of the Feisal-Weizmann agreement notwithstanding, you largely overlooked paragraph 2 in Dr. Yoram Shifftan's article. In this context, Att. Howard Grief said, "[T]he doctrine of estoppel applies . . . to all Arab states whose own creation under international law derived from the very same global settlement made by the Principal Allied Powers at San Remo and Sevres which led to the establishment of the Jewish State. The Arabs cannot gleefully accept national rights accorded them under this settlement while at the same time denying them to the Jewish People." Feisal did include a reservation in the Feisal-Weizmann agreement, so I will stipulate that what you said regarding what Feisal contended is accurate. Please provide us with a citation though so I can have it for future reference. Apart from what I said in this post, it goes without saying that I cannot vouch for factual assertions or interpretations made in Dr. Yoram Shifftan's article or any other comments made in the aforementioned posting. I will check back later and see if anyone can find any verifiable errors in my posting.

I hate to be one to find an error in my own posting, but the memorandum mentioned in my previous posting was not approved on "July 24, 1922." That was the date the Mandate itself was confirmed. The memorandum was presented to the League Council on September 16, 1922 and it was subsequently approved.

Where is the "right of refugees" written in "international law"? Or there descendents? Or the people they married? As for the all non-Jews being "forcefully transfered", they haven't been. You may not realise that Israel has over a million Israeli arabs. It is also a fact that following arab violence starting in 1919, the British started pandering to them. It shaved off Trans-Jordan. It gave the Golan to Syria. The halting of Jewish immigration - a contributing factor to the Holocaust - was again a response to the Arab revolt of 1936-1939. Faisal may have considered the treaty moot but then again he was simply laying down a long and not so proud tradition of not keeping his responsibilities whilst demanding "rights".

The United Nations is the legal succesor of the League of Nations, fully authorised to overtun any decision of the League of Nations. The partition resolution of November 29, 1947 - exactly sixty years ago - rendered all these documents you quote null and void. Clearly it is you do not understand international law at all. The Geneva Convention does not apply to land that you own. We own all the land West of Jordan. So your claim that Professor Shiftan is selective is wrong, it is you that are selective. The Geneva Convention doesn't nor has it ever applied in Judea or Samaria.

Not only are the US, the EU and assorted nations outlaws by demanding Israel give up ANY land, but Israel's leaders are the WORST offenders. For IF they were to stand by our patrimony, and uphold all these legal precedents, there would not be a damn thing the world could do to make them capitulate. Of course the US could threaten Israel, as they have done many times. However, let's be clear. Israel gives more to the US than the US gives to Israel. All the aid comes with huge strings attached, most of which is plowed back into US coffers. Further, Israel is now able to sustain itself financially if the US jumps ship. Of course it would be better to have the US in Israel's corner. But truth be told, Israel is only useful to the US under certain circumstances. Better to stand on its own two feet than to give into blackmail. Further, the Arabs have the oil and that IS that.

Muslims were created ONLY after Prophet Mohammed started to preach -- namely in 610 AD. At the time of Abraham there was NO Islam religion -- so, how can you call Abraham a Muslim ? BTW Abraham always and ONLY worshipped the Supreme Lord -- and NO one else !!!! You have mentioned Abraham worshipping another god -- and that is WRONG. WHY ?
