Appears to be another boondoggle created by the omniprescient, Arab apologist, propoganda machine. Btw, the use of the term "intellectuals" is vastly overated. The article said that this is a "new" civil court created for the express purpose of discussing (adjudicating?) war crimes. Under whose auspices? Can I create my own court too? The answer must be of the affirmative since it is in Belgium.

As several others here have pointed out, the people living in Gaza are *NOT* part of any country. These are terrorists without a country because no country wants them. Without a country, how can they bring charges in a court under EU jurisdiction? This is absurd under two points: 1) The Middle East is regarded as part of Asia, not Europe. EU is clearly the wrong venue based on geographical representation. 2) More importantly, as mentioned above TERRORISTS ARE NOT CITIZENS OF ANY COUNTRY. If these alleged "judges" had and guts, or understanding of the law, the case would be summarily dismissed for lack of legal standing.

This 'private court' if established will be outside the operation of the constitutional frame of law. It is similar to the Volksgerichtshof or People's Court established by Hitler to persecute those whose conduct was otherwise lawful under the existing German law

Dichter (former Shin Bet head) provided the intelligence necessary, and the final approval, to drop a one-ton bomb on the residential area of Al-Daraj in Gaza just before midnight on July 22, 2002, killing 15 people, including 8 children, and injuring 150 others. Ya’alon (former IDF chief of staff) carried out war crimes, extra-judicial killing, crimes against humanity, and cruel, inhuman or degrading treatment or punishment for his role in the 1996 shelling of a United Nations compound in Qana, in the south of Lebanon. Survivors of the 1982 Sabra and Shatila massacre brought suit against Ariel Sharon, Amos Yaron, and Rafael (Raul) Eitan, charging them with war crimes, crimes against humanity and genocide. Belgium’s Supreme Court held that the country’s 1993 Anti-Atrocity legislation allowed for prosecution in absentia, thereby finding the plaintiffs’ bases for appeal of a lower court decision to be well-founded, and allowed the case to proceed. Simultaneously however, the Supreme Court found Sharon to be temporarily immune from prosecution as Israel’s acting head of state. A court in central London, issued an arrest warrant for Maj. Gen. Doron Almog . Suing foreign persons for war crimes began as early as 1962, when the Israeli Supreme Court tried Adolf Eichmann for the war crimes he committed against European Jews as a Nazi officer. To justify its abduction and trial of Eichmann, the Israeli High Court held that some crimes “are of such gravity and magnitude that they warrant their universal prosecution and repression.” Suing foreign persons for war crimes in U.S. courts began in 1980, when human rights practitioners initiated a civil suit against a Paraguayan police officer for the alleged torture of the Paraguayan plaintiff’s son. Why shouldn't Court be established in Israel? There are twenty-three different types of violations and restrictions on the enjoyment of economic, social, and cultural rights in Israel and the Occupied Palestinian Territories, including discrimination against non-Jews, expropriation of Palestinian land and resources to expand exclusively Jewish settlements, the practice of house demolitions and restrictions on family reunification and residency rights, and the policy of closure. Widespread and systematic discrimination against ethnic and religious minorities continued to be a serious problem. HR Organizations have repeatedly urged Israel to to "recognize existing Arab Bedouin villages, the land rights of their inhabitants and their right to basic services, including water"; and "as a matter of the highest priority, to undertake to ensure safe passage at checkpoints for Palestinian medical staff and people seeking treatment, the unhampered flow of essential foodstuffs and supplies, the safe conduct of students and teachers to and from schools, and the reunification of families separated by closures. In 1998 ruling, the High Court of Justice acknowledged that "there is no equality for Arab religious communities in budget allocations of the Ministry of Religious Affairs," but declined to rule on whether Israeli law safeguarded the right to equality. In 1998 the ministry had allotted 1.86 percent of its budget to the combined Muslim, Christian, and Druze communities, although they comprised close to 20 percent of the population.

Here's an idea - Why not go after the true criminals, ie...Islamic Terrorists, Arab/Islamic leaders like Moqtada Al-Sadr, Iran's President Ahmadinejad, Syria's Leadership, terrorist groups and leaders throughout Africa & Indonesia, Serbian Leaders and so many , many more. An writ was served on Ya'alon in New Zealand for "war crimes", it was thrown out of court. Sharon sued Time for claiming he had committed "war crimes", Time lost. In the UK, immediately after the second Lebanon war, a "human rights" group brought a writ against Israel for comitting "war crimes", it was thrown out of court with the judge calling it "hopeless" and "having no chance of success". People tried to bring writ against Dicter and Ya'alon in the US and that suit failed. So far each and every one of these "war crimes" trials has fallen at the first hurdle. Even the infamous ICJ judgement against Israel,had each and every one of the non-muslim, non-arab judges claiming ruling was dubious with one judge voting outright against it. This is without Israel even bothering to present any evidence, that is how weak the anti-Israeli case was. Along with meaningless press releases of "boycotts", which turn out to be nothing of the sort, this press release seems to be completely made up. There is no report of this in any of the other media.
