As several others here have pointed out, the people living in Gaza are *NOT* part of any country. These are terrorists without a country because no country wants them. Without a country, how can they bring charges in a court under EU jurisdiction? This is absurd under two points: 1) The Middle East is regarded as part of Asia, not Europe. EU is clearly the wrong venue based on geographical representation. 2) More importantly, as mentioned above TERRORISTS ARE NOT CITIZENS OF ANY COUNTRY. If these alleged "judges" had and guts, or understanding of the law, the case would be summarily dismissed for lack of legal standing.

An writ was served on Ya'alon in New Zealand for "war crimes", it was thrown out of court. Sharon sued Time for claiming he had committed "war crimes", Time lost. In the UK, immediately after the second Lebanon war, a "human rights" group brought a writ against Israel for comitting "war crimes", it was thrown out of court with the judge calling it "hopeless" and "having no chance of success". People tried to bring writ against Dicter and Ya'alon in the US and that suit failed. So far each and every one of these "war crimes" trials has fallen at the first hurdle. Even the infamous ICJ judgement against Israel,had each and every one of the non-muslim, non-arab judges claiming ruling was dubious with one judge voting outright against it. This is without Israel even bothering to present any evidence, that is how weak the anti-Israeli case was.
