Daniel ,   TA -IL   (10.21.18)
aharaon barak did not, does not and will never understand the concept of the rule of law and the required trias politica with its innate checks and balances. He is a racist elitist, who wants to impose his views on whomever may disagree with him and created a judicial tyranny for the purpose thereof! The political power in a true democracy rest with the elected representatives of the people. The courts only have to check if theses representatives do not violate fundamental rights and laws. By overstepping his boundries - knowingly and willingly - this theocrat of socialism violated the most important rule of law to establish a dictature of the court!

jewish law prescribes the setting up of courts of law.
the seven noachadic laws were given by g-d to humanity and those
who keep these laws are righteous and ensured of place in the world
to come.
the seventh law commands all humans to set up courts of law and ensure
justice in our world.
the purpose of courts of law is to keep harmony within society.

in ancient times, including in the times of the israelites, equality before
the law was not always guaranteed. yet it is only with the promulgaion
of equality before the law that democracy can begin to flourish.
only equals can all have the right to petition the courts.

equality before the law is complex. it is well accepted that enemies
do not have absolute equality with citizens. however, those who
keep the laws of the land are considered righteous.

certain principles of law are considered supra to others. these principles
of law include freedom of speech, freedom of press, freedom of
assembly, freedom of religion.
these freedoms complement the principle of equality since they ensure
the capacity of all to petition not only the courts, but also to petition
governments and to spread ideas among people.

courts would be useless if they were not independent of governments
and parliaments.
courts can be independent only if the judges sitting on courts are
themselves independent.
judicial independence must ensure that courts do not become instruments
of tyranny.
hence, first and foremost, appointment of judges must be impartial.
members of the judiciary cannot take part in the appointment of
judges since such appointment would not be impartial. by definition,
judges cannot be impartial when appointing their peers.
parliaments and professional judicial organisations would inject
unwanted political influence into judicial selections.
yet some measure of place for elected parliaments must be maintained
since they represent the will of the people.
in order to protect judges from undue political influence, their terms
of services must be for life and their renumeration fixed.
ultimately, the independence of the courts will depend in large
measure on the honour of the courts, their conscience and their
prestige.
