Olympus sues Given Imaging over patent

Japanese imaging giant claims Israeli Pill Cam maker infringed patent purchased in 2005 from Boeing

The Japanese imaging systems giant Olympus is suing Given Imaging, the Israeli maker of the Pill Cam. Olympus demanded that the court rule Given's Pill Cam is an infringement of a patent Olympus registered in the past.

 

The Japanese corporation, using its subsidiaries Olympus Medical Systems and Olympus America, claimed that Given infringed one of its patents.

 

Olympus claims the patent, called "High Frequency, Low Power Light Source for Video Camera," is in effect until 2008. The patent was purchased in June 2005 from Boeing.

 

Given Imaging released a statement saying its Pill Cam capsule does not infringe on or use inventions related to elements registered under a valid patent.

 

Last month, the United States Patent and Trademark Office acknowledged that 13 of the 17 patents filed by Given are valid. Given officials said they believe that Olympus' claims are baseless.

 

This is not the first time both companies compete against each other. Olympus owns a product similar to Given's Pill Cam and is expected to receive the approval of the American Food and Drug Administration this summer.
