'Katsav should not be indicted'

Suspended president’s defense team says newly attained missing evidence undermines indictment; hearing set before attorney general

Missing investigation material recently received by President Moshe Katsav’s defense attorneys completely undermines the complainant’s claims, according to Zion Amir, one of Katsav’s.

 

The president’s defense team is preparing for a hearing with Attorney General Menachem Mazuz, prior to his decision on whether or not to file an indictment, and under what charges.

 

According to Eli Abarbanel, Jerusalem District Attorney, and Efrat Barzilai, head of the Criminal Department of the State Attorney's Office, there were no grounds for an indictment against Katsav based on the newly attained missing material.

 

Amir said the complainant should never have signed the indictment, and added, “I would not be exaggerating if I said a case with evidence like this was every defense attorney’s dream.”

 

Although he was not at liberty to discuss the investigation material, Amir also said that there was a good reason that two top attorneys were not prepared to go to court with this case.

 

Katsav’s defense team filed a petition with the High Court of Justice on Thursday, demanding access to the missing material, and the State Prosecutor's office's minority opinion on the sexual harassment affair.
