Outgoing Prime Minister Ehud Olmert and his ministers constitute an interim government now, pursuant to Olmert's official resignation last week, emphasized Attorney General Menachem Mazuz. As such, they should refrain from legislating on non-routine issues without consulting him, he stated.
In a letter to members of the Olmert government, Mazuz wrote that, from the moment Olmert submitted his letter of resignation to President Shimon Peres, the government itself is also considered to have given its resignation.
According to Mazuz, the scope of the government's jurisdiction has now decreased. "Given the temporary nature of an interim government that lacks the confidence of the Knesset, the government and the ministers in such an interim government must demonstrate restraint regarding decision-making on non-routine issues requiring immediate attention during this interim period," he wrote.
"As such, when such non-routine issues come up, ministers must conduct preliminary inquiries into the matter with the Attorney General's office, before reaching a decision," he added.
He wrote that this interim government must function exactly as a government would function following a no-confidence vote from the Knesset.
